53 The Board of Commissioners for the County of Cabarrus met in regular session at the County Courthouse in Concord, North Carolina, on Monday, September 17, 1984, at 7:00 P.M. Present - Chairman: James W. Lentz Commissioners: Archie Y. Barnhardt Marcelle Milloway J. Harold Nash Kenneth F. Payne The invocation was given by Reverend Clyde Hawkins of Centerview Baptist Church of Kannapolis, North Carolina. The minutes of September 4, 1984, were corrected to identify those signs for which Commissioner Nash had proposed an ordinance prohibiting placement on public property as "political signs" UPON MOTION of Commissioner Milloway, seconded by Commissioner Nash and unanimously carried, the minutes of September 4 and September 6, 1984 were approved as corrected. The Board received the recommendations as submitted in a memorandum from Mr. Thomas B. Robinson, Planning Director, regarding the terms of County water service to Silver Maples Estates, a mobile home development presently served by a public utility company. Several requests had been made by Mr. Don Sellers, Director of Silver Maples Estates, for an amendment to the current Water System Policies and Regulations which would provide for the sale of water to a utility company at a bulk or commercial rate. Mr. Sellers had also offered to convey to the County the private water lines in the subdivision adjoining the mobile home park if the County would approve a commercial rate for his development. It was the recommendation of Mr. Robinson that the adopted water policies remain intact and that mobile home parks be extended water service in accordance with Section D "Extensions in Shopping Centers, Mobile Home Parks, and Multi-Family Developments" or Section F "Manifold Connections" of the current policies. Mr. Robinson also recommended that the County not accept the water lines in the adjoining subdivision except for abandonment purposes should they be offered. Mr. Don Sellers, Director of Silver Maples Estates, stated displeasure with the recommendation of the Planning Director regarding his request for a bulk water rate and expressed concern that the County would spend money to run water lines parallel to lines already in existence. In conclusion, Mr. Sellers advised the Board if the County took away any amount of revenue from their utility company by servicing their present customers that the utility company along with the North Carolina Utilities Commission would enter into ligitation against the County. The Board received the presentation by Mr. Sellers as information only and took no action in this matter. The Honorable Bernie A. Edwards, Mayor of the City of Concord, objected to the Cabarrus County Landfill tipping fees adopted by the Board of Commissioners on July 16, 1984, to be effective October 1, 1984. He expressed concern that the City of Concord had not been notified of discussions relating to the proposed tipping fees and that the tipping fees had been approved after the adoption of the 1984-85 budget for the City of Concord. He stated it would presently cost the City of Concord $36,000.00 per year in tipping fees and would impose double taxation on the citizens of Concord. Mayor Edwards pointed out that the City of Concord does not charge County residents for the use of City recreation facilities and that the City would be selling water to the County at in-city rates. In conclusion, Mayor Edwards asked that the imposition placed on the citizens of Concord be rescinded. The motion by Commissioner Barnhardt and seconded by Commissioner Milloway to rescind the tipping fees at the Cabarrus County Landfill failed with Commissioners Milloway and Barnhardt voting for and Commissioners Payne and Nash and Chairman Lentz voting against. Commissioner Milloway proposed that the City and County officials meet each quarter to discuss common concerns. Mrs. Sue Casper, President of Keep Cabarrus Beautiful, Inc. and resident of the area near the County Landfill, stated that County residents were affected the most both financially and physically by the disposal of solid waste. She cited such examples as the devaluation of property near the landfill, the damage to roads leading to the landfill, and the incon- venience to the residents of the area caused by traffic congestion and litter which falls from the garbage trucks in route to the landfill.
