164 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />August 17, 1987, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> R. Giles Moss <br /> The invocation was given by Reverend Jimmie W. Holland of the Royal Oaks <br />United Methodist Church. <br /> The minutes of August 3, 1987, were corrected to read as follows. <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne <br />and unanimously carried, the Board adopted the following resolution. <br /> <br />As we have been having a number of contract discussions <br />with the Town of Harrisburg over rights and responsibilities <br />under contracts now existing, I would like to make a motion <br />that we authorize the attorney for the Board to initiate an <br />action for declaratory judgment in order that we may ask the <br />local courts to determine each party's rights and responsi- <br />bilities under these contracts and that the parties in <br />Harrisburg be notified that this action is not actually a <br />suit against them but merely an action to clarify our status <br />and their status in regard to those contracts. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Melvin and <br />unanimously carried, the minutes of August 3, 1987, were approved as <br />corrected. <br /> Chairman Lentz stated that the public hearing regarding the proposed <br />Zoning Text and Atlas amendments and the proposed Mobile Home Park Ordinance <br />Text amendment would be held at this time. <br /> Mr. Larry Loving, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. Phillip Kingsland, member of the Planning Department staff, <br />reviewed the location of the areas proposed for rezoning. Public input was <br />received prior to action by the Board of Commissioners. <br /> <br />ZONING TEXT AMENDMENT <br /> <br />(1) <br /> <br />Petition 87-07. John Crosland Company, Section 3.10 Ten Year Growth <br />Transition Overlay District, page 53. Expand Ten Year Growth District <br />to boundary stated on Petition 87-07. Planning Board voted unanimously <br />to recommend approval. <br /> <br /> Mr. Gene Crabtree of the Steeplechase Communityquestioned the number of <br />co~unity sewage plants being built in that area of the county and expressed <br />concern regarding the effect that the growth would have on the aesthetic <br />appearance of his community. <br /> Mr. William G. Alexander, Attorney representing the John Crosland <br />Company, requested approval of Petition 87-07. He stated this section of the <br />County is a tremendous growth area and inclusion in the Ten Year Growth Area <br />would be helpful to Cabarrus County. <br /> A resident of the area questioned the effect the planned community would <br />have on the area schools, traffic, and sewer systems. <br /> Mr. Gene Greene objected to the lot sizes that would be allowed in the <br />new development. <br /> There being no one else to speak regarding the proposed amendment, <br />Chairman Lentz closed the public hearing. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne with <br />Commissioners Hamby, Payne, and Moss voting for and Chairman Lentz and <br />Commissioner Melvin voting against, the Board approved Petition 87-07 by th~ <br />John Crosland Company amending the Zoning Text, Section 3.10 Ten Year Growth <br />Transition Overlay District, page 53, to expand the Ten Year Growth District <br />as stated below. <br /> <br />Description of Area: Beginning at the southern edge of the ten-year <br />growth area at the intersection of Robinson Church Road and Rocky River <br />Road; thence with the centerline of Robinson Church Road in a southerly <br />direction to the intersection of Robinson Church Road and Peach Orchard <br /> <br /> <br />
