221 The Board of Commissioners for the County of Cabarrus met in recessed session at the County Courthouse in Concord, North Carolina, on Thursday, November 12, 1987, at 10:00 P.M. Present - Chairman: James W. Lentz Commissioners: Kenneth F. Payne William G. Hamby, Jr. Martha H. Melvin Absent - Commissioner: R. Giles Moss Members of the Concord Board of Aldermen present for the meeting were as follows: Mayor Pro-Tem James L. Dorton and Aldermen T. Laine Harling; Robert L. Mathis, Jr.; Lamar Barrier; and Dr. Hector H. Henry. Mr. Gordon L. Belo, Attorney for the City of Concord, read two letters which he stated the Concord Board of Aldermen had adopted as official action during their regular meeting on this date. The first letter dated August 20, 1987, to Chairman James W. Lentz from Mayor Bernie A. Edwards regarded the City's objection to the alleged relocation of Highway 73 and bridge across Coddle Creek as well as the construction of the Coddle Creek Dam in the vicinity of the existing Highway 73 bridge and the City's existing pumping station. In his letter, Mayor Edwards requested that the Board of Commissioners "not proceed with the expenditure of any additional public funds to implement this alternative". The second letter dated November 5, 1987, to Mr. Paul C. Watson, Jr., P.E., of HDR Infrastructure, Inc., from Mr. Leonard B. Sossamon, Concord City Manager, stated that "you and your firm are hereby notified to discontinue any and all future surveying, soil borings and any other related work on property owned by the City of Concord in the Coddle Creek Reservoir project." Dr. Hector H. Henry read the following proposal from the City of Concord. CODDLE CREEK PROPOSAL The Concord Board of Aldermen agrees to allow the Cabarrus County Board of Commissioners to pursue the development of the Coddle Creek Dam and Reservoir with HDR. For this concession, the Concord Board feels that the City should receive some material benefit from the County in terms of a percentage guarantee of a specific amount of water. The Concord Board of Aldermen also feels that the City should receive an additional percentage guarantee of a specific amount of water for compensation relative to the funds the City has expended previously for project development, i.e. plans and specifications. The Concord Board of Aldermen shall agree to lease the land acquired by the City in the Coddle Creek Reservoir Project to the Cabarrus County Board of Commissioners in order for the County to develop, own and operate the Dam and Reservoir. e It is the contention of the Concord Board of Aldermen that the conces- sions contained in items 1, 2 and 3, including the lease of real property should generate a percentage guarantee of water from the County to the City of 50 percent of the total yield of water from the Reservoir. The City and County shall agree that the County will finance the entire project via the $14.5 million General Obligation Bonds and amortize such itself. The City and County shall agree that the County shall operate the Coddle Creek Reservoir and establish raw water rates and that the raw water rates for the City of Concord shall be the best for all County customers (i.e., storage only). The City and County shall agree that the City shall continue to operate the Hillgrove Water Filter Plant and expand such facility as the City and County needs dictate. The City and County shall agree that the County shall agree not to develop a water filter plant and that the County shall be afforded the best treated water rates established by the City for all customers.
