221 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina on Monday, October <br />16, 1989, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> Commissioner Simmons was absent for the beginning of the meeting. <br /> The invocation was given by Reverend F. Donald Beatty of the Central United <br />Methodist Church. <br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Hamby with <br />Commissioners Moss, Hamby, and Melvin and Chairman Lentz voting for, the minutes <br />of September 25, October 2, and October 4, 1989 were approved as written. <br /> Chairman Lentz announced that the public hearing scheduled for Zoning Text <br />Petition 89-02 (Section 4.12, "Subdivision Lot Size Reduction") and Subdivision <br />Regulations Text Petition 89-02 (Section 4.9, Number 14, "Roads") would not be <br />held on this date. He explained that the public hearing notice sent to the local <br />newspapers had been lost in the mail and therefore not publicized as required. <br />A public hearing for these petitions will be held on November 20. <br /> Dr. Nancy Randall, Chairman of the Cabarrus County Planning Board, reviewed <br />Zoning Text Petition 89-03, Sign Regulations, for which a public hearing was held <br />on July 24, 1989. The regulations had also been discussed in a joint work <br />session by the Board of Commissioners and Planning Board on August 16, 1989. <br />The Petition as recommended by the Planning Board was as follows. <br /> <br />Petition 89-03. Planning Staff (by request of the Cabarrus County <br />Planning Board and Zoning Board of Adjustment), amend Section 5.6 <br />"Sign Regulations" In addition, the following changes are required <br />to reconcile the sign regulation changes to the remainder of the <br />Zoning Ordinance: <br /> <br />a. Amend Section 16 "Definitions", page 128, by <br /> deleting the word "sign" from the definition of <br /> "s tructure". <br />b. Amend Section 3.2-4 "Schedule of Use Regulations", <br /> page ll-J, by deleting the line item for "Signs <br /> (Advertising)" <br />c. Amend Section 3.2-4 "Schedule of Use Regulations", <br /> page ll-J, to change the line item for "Signs (Off- <br /> Premise)" to not permit these signs in the C-3 <br /> zoning district. <br /> <br />The Planning Board voted 5-0 to approve this petition. <br /> <br />Chairman Lentz asked if anyone were present who wished to speak for or <br />against the Petition 89-03. <br /> Mr. Bill Powlas, owner of Bill's Junk Car Service, asked if his <br />advertising sign could remain as it currently stands. Mr. Michael M. Ruffin, <br />County Manager, pointed out that Mr. Powlas' sign would be considered a non- <br />conforming sign under the proposed regulations and would be permitted to remain <br />as long as Mr. Powlas maintains the sign in its current condition. However, it <br />was noted by Chairman Lentz that Mr. Powlas' sign would be subject to any future <br />revisions to the sign regulations. <br /> There being no one else to speak regarding Petition 89-02, Chairman Lentz <br />closed the public hearing. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Melvin with <br />Commissioners Hamby, Melvin, and Moss and Chairman Lentz voting for, the Board <br />approved Petition 89-03 amending Section 5.6 "Sign Regulations" of the Cabarrus <br />County Zoning Ordinance as recommended by the Planning Board. Section 5.6 "Sign <br />Regulations" is contained in the Cabarrus County Ordinance Book and is hereby <br />included by reference as a part of the minutes. The Board further approved the <br />following changes to reconcile the sign regulation changes to the remainder of <br />the Zoning Ordinance: <br /> <br />a. Amend Section 16 "Definitions", page 128, by deleting the <br /> word "sign" from the definition of "structure". <br />b. Amend Section 3.2-4 "Schedule of Use Regulations", page ll- <br /> J, by deleting the line item for "Signs (Advertising)" <br /> c. Amend Section 3.2-4 "Schedule of Use Regulations", page 11- <br /> <br /> <br />
