NORTH CAROLINA Planning and Zoning Commission Minutes September 26, 1996 7:00 P.M. Ms. Katherine Stafford, The Chair, called the meeting to order at 7:07. Members present in addition to the Chair were Ms. Monica Davis, Mr. Ronald Davis, Mr. Clyde Drye, Jr., Ms. Janice Harkey, Mr. Ed Hill, Mr. Carleton Hobbs, Mr. Walter Kiefer, Mr. Benjamin Lane, Mr. Dewey Moose, Jr., and Mr. Aaron Ritchie. Attending from the Planning, Zoning, and Building Inspection Department were Mr. Jonathan B. Marshall, Senior Planner, Mr. Michael K. Downs, Zoning Administrator, Mr. Michael L. Byrd, Transportation Planner, and Ms. Phyllis C. Carr. Also attending was Mr. Richard Koch, Attorney for the Planning and Zoning Commission. There being no corrections to the August 15, 1996 Minutes, Mr. Ritchie MOTIONED, seconded by Mr. Moose to approve the minutes as mailed. The vote was unanimous. Old Business The Chair introduced the first item of old business on the Agenda, Planning Board Function, Subdivision Exception Request~ Petition 96-0i(S): 1. Applicant: Mr. & Mrs. McGuire- Country. Barn Road Request: Subdivision Exception Request This was a request to the Cabarrus County Planning and Zoning Commission from Mr. & Mrs. McGuire for a subdivision exception request. Mr. Michael Byrd, Transportation Planner, addressed the Board stating this petition was delayed from last month's meeting. He said this is a variance from Section 4.1 of the Subdivision Regulations regarding roads that requires a 45 foot right-of-way. Mr. Byrd said as far as we can tell, there was no recorded right-of-way on any of the deeds for this road. This is one of the concerns the staff had. Because of that, the staff does not recommend approval until some type of right-of-way is acquired to serve the property. He said he thinks that P. O.
