NORTH CAROLINA <br /> <br />Planning and Zoning Commission Minutes <br />September 26, 1996 <br />7:00 P.M. <br /> <br />Ms. Katherine Stafford, The Chair, called the meeting to order at 7:07. Members <br />present in addition to the Chair were Ms. Monica Davis, Mr. Ronald Davis, Mr. <br />Clyde Drye, Jr., Ms. Janice Harkey, Mr. Ed Hill, Mr. Carleton Hobbs, Mr. Walter <br />Kiefer, Mr. Benjamin Lane, Mr. Dewey Moose, Jr., and Mr. Aaron Ritchie. <br />Attending from the Planning, Zoning, and Building Inspection Department were <br />Mr. Jonathan B. Marshall, Senior Planner, Mr. Michael K. Downs, Zoning <br />Administrator, Mr. Michael L. Byrd, Transportation Planner, and Ms. Phyllis C. <br />Carr. Also attending was Mr. Richard Koch, Attorney for the Planning and <br />Zoning Commission. <br /> <br />There being no corrections to the August 15, 1996 Minutes, Mr. Ritchie <br />MOTIONED, seconded by Mr. Moose to approve the minutes as mailed. The <br />vote was unanimous. <br /> <br />Old Business <br /> <br />The Chair introduced the first item of old business on the Agenda, Planning <br />Board Function, Subdivision Exception Request~ Petition 96-0i(S): <br /> <br />1. Applicant: Mr. & Mrs. McGuire- Country. Barn Road <br /> Request: Subdivision Exception Request <br /> <br />This was a request to the Cabarrus County Planning and Zoning Commission <br />from Mr. & Mrs. McGuire for a subdivision exception request. <br /> <br />Mr. Michael Byrd, Transportation Planner, addressed the Board stating this <br />petition was delayed from last month's meeting. He said this is a variance from <br />Section 4.1 of the Subdivision Regulations regarding roads that requires a 45 <br />foot right-of-way. Mr. Byrd said as far as we can tell, there was no recorded <br />right-of-way on any of the deeds for this road. This is one of the concerns the <br />staff had. Because of that, the staff does not recommend approval until some <br />type of right-of-way is acquired to serve the property. He said he thinks that <br /> <br />P. O.
