NORTH CAROLINA <br />Planning and Zoning Commission Minutes <br />August 20, 1998 <br />7:00 P.M. <br /> <br />Mr. Ed Hill, Chairperson, called the meeting to order at 7:00 p.m. Members <br />present in addition to the Chair were Ms. Monica Davis, Mr. Clyde Drye, Jr., Mr. <br />Thomas Dwiggins, Mr. Carleton Hobbs, Mr. Walter Kiefer, Mr. Dewey Moose, Jr. <br />Mr. Aaron Ritchie and Mr. Ric Starnes. Attending from the Planning and <br />Development Services Division were Mr. Michael Byrd, Mr. Jay Lowe, and Ms. <br />Phyllis C. Carr. Also attending was Mr. Richard Koch, Attorney for the 'Planning <br />and Zoning Commission. <br /> <br />There being no corrections to the July 16, 1998 Minutes, Mr. Ritchie MOTIONED, <br />seconded by Mr. Hobbs to approve the minutes as mailed. The vote was <br />unanimous. <br /> <br />The Chair introduced the first item on the Agenda, Right-of-way Exception <br />Request: <br /> <br />Applicant: James & Sheila Mullis <br />Request: Right-of-way Exception Request <br /> <br />This was a request to the Cabarrus County Planning and Zoning <br />CommiSsion from James & Sheila Mullis. They are requesting an <br />exception from the right-of-Way requirements in the subdivision <br />regulations. <br /> <br />Mr. Michael Byrd, Transportation Planner, addressed the Board <br />presenting this right-of-way exception request stating that the <br />Board has a letter in front of them from James & Sheila Mullis <br />requesting an exception for the 45 foot right-of-way requirements <br />in the subdivision regulations. He said the exception request 'is <br />before the Board because the Mullis' wants to refinance their house <br />and cut one acre out of six acres. When they came to have that <br />revision approved with our office, we realized that they needed a <br />45-foot right-of-Way down to the lot that they are dividing out to <br />meet the requirements. They were unable to get a 45-foot right-of- <br />way because of other existing structures on the property. <br /> <br /> Planning Services Division <br /> <br />P. O.
