[CABARRUS COUNTY~ NORTH CARO.LINA Planning and Zoning Commission Minutes October 2 ~, !9.99 7'00 P.M. Mr. Ed Hill, Chairperson, called the meeting to order at 7'15 p.m. Members present in addition to the Chair were Mr. Bill Babb, Ms. Monica Davis, Mr. -Thomas Dwiggins, Mr. Carleton Hobbs, Ms. Martha Kiker, .Mr. Dewey Moose, and Mr. Ric Starnes. Attending.from the Planning Services and Development .Services department were IVir. Eddie IVloore, Senior Planner, !Vlr. Brad Lagano, Senior Planner, Mr. Jay Lowe, Zoning Inspector, and ~s. Phyllis C. Carr. Also attending was lVlr. Richard Koch, Attorney for the Planning and Zoning Commission. There was one correction made to'the September 30, 1999' Minutes. Ms. Kiker said she would like to change her vote on Conditional Use Application 240(C), D. Keith Price/Truth Temple. Ms-. Kiker said after due consideration she would like for her vote to be in the affirmative. The Chair said that is on page 12 in the minutes. He said that would make the vote 8 to 1 with.Mr. Starnes dissenting. Mr. Dwiggins asked if that would require a vote from the Board. Mr. Koch, Attorney for the Planning and Zoning Commission, said there would still be a vote required on approval of the minutes. But, under the. rules any member is entitled to change their vote up to the point of approval of the minutes from that preceding meeting or if a permit had been 'issued, which ever occurs first. In this case, since it was denied because it did not reach super majority, there was no permit issued. Ms. Kiker vOte is perfectly acceptable and there is no motion and vote necessary. There being no further comments Mr. Dwiggins MOTIONED to approve the Minutes as amended, seconded by Mr. Hobbs. The vote' was 8 to 1, Mr. Starnes dissenting.- The Chair introduced the first item on the Agenda, Preliminary Subdivision Plat Approval, Petition C99-08(S)' Planning Services Division P. O.
