Planning and Zoning Commission Minutes <br />November 18, 1999 <br /> <br />Page 2 <br /> <br />The Chair asked Mr. Lowe to give the Board a history of this <br />request and the location. He said he remember it was an <br />application that was declined. <br /> <br />IVlr. Lowe indicated that the first application had been denied. He <br />said in the very beginning the man from General Towers came into <br />the office with a petition for a 300 feet tower. He said that petition <br />was denied. One month later the man from General Towers <br />resubmitted a petition to lower that tower height to 199 feet. The <br />Board decided to go ahead and approve that conditional use. Now, <br />General Towers has sold that tower right to SBA Towers, Inc. They <br />have transferred the permits over to SBA Towers name. IVlr. Lowe <br />said he has submitted this as an existing tower. He said he knows <br />that the .permits were just changed over to SBA Towers, maybe <br />less than a week ago. He said he does not know if the tower has <br />been completely constructed or not. Mr. Lowe said the conditional <br />use that Passed at 199 feet, the applicant is submitting it before <br />the Board tonight to add an additional 50 feet to it. He said <br />without coming before this board, they could come into our office <br />and go 20 feet with it. That would be the max'. That does not <br />require approval through the Board. They could go up to 219 feet <br />without any further approval, but they are asking for 50 feet that is <br />why they are back before the Board tonight. <br /> <br />IVlr..lonathan Yates, SBA Communications, addressed the Board <br />stating this is a testament to how in fact the Cabarrus County <br />ordinance is working. He said General Towers came in earlier this <br />year seeking to build a 300-foot tower. They were turned down <br />and they~ did not have a tenant at the time. They came back again <br />wanting to build the tower at 199 feet and they still did not have a <br />tenant at that time. With that tower permitted, it takes up a certain <br />portion of that part of the county and under the county rules if <br />possible, .NEXTEL has to use that permitted site whether it is built <br />or not. Mr. Yates said-NEXTEL required height to make their <br />coverage objectives is 250 feet. He said SBA had the assignment <br />to place NEXIEL somewhere in that area at the 250-foot level. <br />Unfortunately, with the proposed 199-foot tower, under the <br />ordinance, they cannot build a 250-foot tower in that area. Mr. <br />Yates said the tower is under construction it should be complete <br /> <br /> <br />
