NORTH CAROLINA <br /> <br />Cabarrus County. Planning and Zoning Commission Minutes <br />July 21, 1994 <br />7:00 P.M. <br /> <br />Dr. Nancy H. Randall, Chairperson, called the meeting to order at 7:03 p.m. Members present <br />in addition to the Chair were, Mr. Alan Allison, Mr. Lewis Brownlow, Ms. Monica Davis, Mr. <br />Clyde Drye, Jr., Mr. Thomas Dwiggins, Mr. R. Vernon Jeter, Mr. Edward Moose, and Mr. <br />Robert Smith. Attending from the Planning, Zoning, and Building Inspection Department were <br />Mr. Gerald A.~ Newton, Director, Mr. Michael Downs, Zoning Administrator, Mr. Jonathan <br />Marshall, Planner II, Mr. Michael Byrd, Transportation Planner and Ms. Phyllis C. Carr. Also <br />attending was Mr. William Hamby, Jr. Attorney for the Planning and Zoning Commission. <br /> <br />There being no corrections to the June 16, 1994 Minutes, Mr. Jeter MOTIONED, seconded by <br />Mr. Dwiggins to approve .the minutes as mailed. The vote was. unanimous. <br /> <br />The Chair said she would like to congratulate Mr. Jonathan Marshall, member of the planning <br />and zoning staff for receiving his certification for the AICP. <br /> <br />The Chair introduced the first item on the Agenda, Board of Adjustment Function, Conditional <br />USe 193(C). She stated 'to the citizens when we serve as a board of adjustment, we serve in a <br />quasi-judicial capacity. All of the testimony we receive this evening, must be sworn or affirmed <br />testimony. That is because the decisions can only be appealed through the Superior Court <br />System of the State of North Carolina. We have a conditional use request in front of us tonight. <br />A conditional use is a permitted use, but it is not outfight permitted. A permitted use is one that <br />is allowed in a zoning, district. But-one that is conditionally permitted has to be based on <br />standards and perhaps criteria. If the petitioner can demonstrate that all of those criteria are <br />present, then the board is obligated to approve the conditionally permitted use. <br /> <br />le <br /> <br />Applicant: .Cecil R... Medlin/Richard Craven. Racing <br />Request:. Conditional Use Permit 193(C) <br /> <br />This was a request to the Cabarrus County Planning and Zoning Commission <br />from Mr. Cecil R. Medlin, 605 Church Street North, Concord, N.C. 28025 to <br />change from one non-conforming use to another which is less intensive.
