NORTH C,~ROLI NA <br /> <br />Planning and Zoning Commission Minutes <br />September 29, 1994 <br />7:00 P.M. <br /> <br />Dr. Nancy H. Randall, Chairperson called the meeting to order at 7:20 p.m. Members <br />present in addition to the Chair were Mr. Lewis Brownlow, Mr. Clyde Drye, Jr., Ms. Janice <br />Harke¥, Mr. Monica Davis, Mr. R. Vernon Jeter, Mr. Robert Smith, and Ms. Katherine <br />Stafford. Attending from the Planning, Zoning and Building Inspection Department were Mr. <br />Gerald A. Newton, Director, and Ms. Phyllis C. Carr. AlSo attending was Mr. William <br />Hamb¥, Jr., Attorney for the Planning and Zoning Commission. <br /> <br />The Chair moved to the third item on the Agenda, WorkShop, Open Discussion. <br /> <br />Mr. Newton stated to the Board that he would like to move to item number 2 under <br />workshop, a Review of the "taking issue". <br /> <br />Mr. Newton discussed with .the Board the Supreme Court Rules on Dolan v. Tigard. <br /> <br />The Chair introduced the~second item on the Agenda, Conditional'Use Application 194(C)' <br /> <br />The Chair said since .the board is moving into the Conditional Use Applications, that all <br />testimony must be affirmed because the decisions that the board makes are based on expert <br />testimony rather than heresy and any appeal of the board's ruling can only be made to the <br />Superior COurt System of the State of North Carolina. <br /> <br />Conditional Use Application 194(C). Cabarrus County is petitioning the Board of Adjustment <br />to construct and operate a public use facility (sewer treatment plant) on Hopewell Church <br />Road. (PIN 5553-24-9509). The property is currently zoned Low Density Residential. <br /> <br />The Chair then swore in Mr. Gerald A. Newton, Cabarrus County Planning and Development <br />Area Manager. <br /> <br />Mr. Newton addressed the Board presenting Conditional Use Application 194(C). <br /> <br />After discussion, Mr. Jeter MOTIONED to approve ConditiOnal Use Application 194(C) with <br />the findings of fact stated'in the request, seconded by Mr. Smith.
