NORTHCAflOLINA <br /> <br />Cabarrus County Planning and Zoning Commission Meeting <br />May 15, 1991 <br />7:00 P.M. <br /> <br />PUBLIC MEETING <br /> <br />Dr. Nancy Randall, Chairperson, called the meeting to order at 7:00 <br />p.m. Members present in addition to Chairman Randall were Mr. <br />Robert Amos, Ms. Doris Barbee, Ms. Janice Harkey, Mr. Howard <br />Hurlocker, Mr. Edward Moose, Mr. Kenneth Olio-Mills, Mr. Dennis <br />Shultz and Mr. Robert Smith. Attending from the Planning and <br />Zoning Department were Mr. Michael Downs, Zoning Administrator, Mr. <br />Jonathan Marshall, Planner, Mr. Michael Byrd, Planner and Ms. <br />Phyllis C. Carr. <br /> <br />Mr. Amos asked would it be good for the record to list those <br />individuals that are sworn in when the Board is doing a Board of <br />Adjustment action. They were not listed in the minutes, and he <br />just wanted to know as a matter of practice would that be a good <br />policy. <br /> <br />Chairman Randall stated to Mr. Amos the names does not have to be <br />listed, but make sure that we get each persons name who speaks. <br /> <br />There being no corrections to the April 17, 1991 Minutes, Mr. Amos <br />MOTIONED, seconded by Mr. Shultz to approve the minutes as written. <br />The vote was unanimous. <br /> <br />Chairman Randall introduced the first item on the Agenda, Board of <br />Adjustment Action: <br /> <br />1. Applicant: Richard B. Peterson, 3550 Biqgers Road <br /> Request: Conditional Use- 164 (C) <br /> <br />This was a request to the Cabarrus County Planning and <br />Zoning Commission from Richard B. Peters'on for a <br />Conditional Use for light industry, manufacturing/grading <br />and landscaping at this location. <br /> <br />Chairman stated to the citizens that when this Board acts <br />on Board of Adjustment functions they are considered a <br />quasi-judicial body. Chairman asked if any one wish to <br />speak for or against this conditional use, Richard B. <br />Peterson, 3550 Biggers Road, to stand and be sworn. The <br />~North Carolina Supreme Court requires that all testimony <br />that is offered in front of this Board be sworn because <br />any appeals of this Board can only be taken to the North <br />Carolina Superior Court system. People testifying, were <br />then sworn in by Chairman Randall. <br /> <br />Mr. Olio-Mills asked the Chair to be excused from the <br />Board on this conditional use due to financial interest <br /> <br /> <br />
