CAROLINA <br /> <br />Cabarrus County Planning and Zoning Commission Minutes <br />August 15, 1991 <br />7:00 P.M. <br /> <br />PUBLIC MEETING <br /> <br />Dr. Nancy Randall, Chairperson, called the meeting to order at 7:00 <br />P.M. Members present in addition to Chairperson Randall were Mr. <br />Robert Amos, Ms. Doris Barbee, Mr. David Hartgen, Mr. Howard <br />Hurlocker, Mr. Edward Moose, Mr. Kenneth Olio-Mills, Mr. Dennis <br />Shultz and Mr. Robert Smith. Attending from the Planning and <br />Zoning Department were Mr. Michael Downs, Zoning Administrator, Mr. <br />Jonathan Marshall, Planner and Ms. Phyllis C. Carr. Also attending <br />was Mr. William Alexander, Attorney for the Planning and Zoning <br />Commission. <br /> <br />There being no corrections to the July 18, 1991 Minutes, Mr. Shultz <br />MOTIONED, seconded by Mr. Hurlocker to approve the minutes as <br />mailed. The vote was 9-0. <br /> <br />Chairperson Randall stated the first item of business that comes <br />before the Board is the Board of Adjustment Actions. <br /> <br />1. Applicant: Bobby Waltrip - DarWal, Inc. <br /> Request: Conditional Use Permit - 166 (C) <br /> <br /> This was a request to the Cabarrus County Planning and <br /> Zoning Commission from Bobby Waltrip - DarWal, Inc. for <br /> a Conditional Use to create a Race Shop Complex. To add <br /> onto existing structure for Fabrication Shop and to <br /> construct two additional buildings for engine building <br /> and showroom. <br /> <br />Chairperson Randall stated to the citizens in attendance <br />some of the activities the Board will be engaging in. <br />Chairperson Randall stated that there are three general <br />standards that the Board must find. They are finding of <br />facts, the Board must have evidence to support that the <br />petitioner can meet all three of these general standards <br />that the Board has. Another thing the Board asked is <br />that because the State Supreme Court of North Carolina <br />requires that all persons who would like to speak to this <br />body concerning this Board of Adjustment action must give <br />sworn testimony. That is necessary because the Board's <br />action can only be appealed to the Superior Court system <br />of North Carolina. <br /> <br />Chairperson Randall then sworn in people wishing to speak <br />for this petition.
