320 <br /> <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Hamby and <br />unanimously carried, the Board adopted the following resolution. <br /> <br />RESOLUTION AUTHORIZING CONDEMNATION TO ACQUIRE PROPERTY <br /> <br /> WHEREAS, the Board of Commissioners of Cabarrus County, North <br />Carolina, hereby determines that it is necessary and in the public <br />interest to acquire an interest in certain real property owned by <br />the respective individuals identified in Exhibit B in order to <br />extend the system of sewage disposal in the County, more <br />'specifically for the Afton Run Outfall, Pump Station and Force Main <br />Project, and that the respective sums identified in Exhibit B are <br />just compensation therefor; <br /> <br /> WHEREAS, the proper officials or representatives of Cabarrus <br />County have been unable to acquire the needed interest in this <br />property by negotiated conveyance. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS <br />OF CABARRUS COUNTY, NORTH CAROLINA, THAT: <br /> <br /> 1. Cabarrus County shall acquire by condemnation, for the <br />purposes stated above, an easement and right-of-way in the real <br />property described in Exhibits A-i, A-2, A-3 and A-4 attached hereto <br />and incorporated herein by reference. <br /> <br /> 2. The attorneys representing Cabarrus County are directed <br />to institute the necessary proceedings under Chapter 40A of the <br />North Carolina General Statutes to acquire the property herein <br />described and to deposit the sums set forth in Exhibit B with the <br />Clerk of Superior Court for Cabarrus County upon filing such <br />proceedings as just compensation for such real property. <br /> <br />Adopted: This 5th day of March, 1990. <br /> <br />/s/ James W. Small <br /> <br />Clerk <br /> <br /> EXHIBIT A <br />(Harold Ralph Vandelinder) <br /> <br />DESCRIPTION OF ENTIRE TRACT OR TRACTS AFFECTED BY TAKING: <br /> Lying and being in No. 2 Township, Cabarrus County, <br /> North Carolina, on the west side of Interstate Highway <br /> 85, east of Afton Run Creek, the entire tract being Lot <br /> 26, Block 1, of Farm Hill (Map Book 19, Pages 1 and 2), <br /> as more particularly described in Deed Book 538 at page <br /> 646 of the Cabarrus County Registry, incorporated herein <br /> by reference, and identified as Tax Parcel 7.00, Tax Map <br /> 3C, Township 2. <br /> <br />STATEMENT OF PROPERTY TAKEN: <br /> The property taken is a perpetual right-of-way and <br /> easement of thirty (30) feet in width for: (a) a sewer <br /> line; (b) all purposes to which plaintiff is authorized <br /> to subject the same; and (c) during construction, a <br /> right-of-way and easement ten (lO).feet in width on both <br /> the east and west sides of the permanent easement (i.e. <br /> a maximum width of fifty (50) feet). <br /> <br />o <br /> <br />DESCRIPTION OF AREA TAKEN: <br /> Such portion of the tract identified in Paragraph <br /> 1 above that is included in the right-of-way and <br /> easement described in Paragraph 2 above which is more <br /> particularly set forth in a survey and map by Concord <br /> Engineering & Surveying, Inc., dated July 7, 1989, <br /> <br /> <br />
