January 11, 2008 (Recessed Meeting) <br />Page 675 <br />The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Multipurpose Room at the Cabarrus County Governmental Center <br />in Concord, North Carolina on Friday, January 11, 2008, at 12:00 p.m. <br />Present - Chairman: H. Jay White, Sr. <br />Commissioners: Robert W. Carruth <br />Grace M. Mynatt <br />Coy C. Privette <br />Absent - Vice Chairman: Joni D. Juba <br />Also present were John Day, County Manager; Richard M. Koch, County <br />Attorney; Mike Downs, Deputy County Manager; Pam Dubois, Deputy County <br />Manager; Jonathan Marshall, Commerce Director; Susie Morris, Planning and <br />Zoning Manager; Kay Honeycutt, Clerk to the Board and Lori Hinson, Deputy <br />Clerk to the Board. <br />Vice Chairman Juba was absent due to illness. <br />Call to Order <br />Following lunch, Chairman White called the meeting to order at 12:18 <br />p.m. <br />Adequate Public Facility Ordinance Review Process <br />John Day, County Manager, reviewed the following information related to <br />the Adequate Public Facilities Ordinance (APFO): <br />Purpose: <br />• Establishes phasing standards for new development based on the carrying <br />capacity of Public Facilities; and <br />• Ensures that Public Facilities needed to support new development meet <br />or exceed the Level of Service standards established in this section; <br />and <br />• Ensures that no applications for development approval are approved that <br />would cause a reduction in the levels of service for any Public <br />Facilities below the Adopted Level of Service established in this <br />Section; and <br />• Ensures that adequate Public Facilities needed to support new <br />development are available concurrent with the impacts of such <br />development, or within a reasonable period of time; and <br />• Encourages development in areas where public services are available and <br />underutilized; and <br />• Establishes uniform procedures for the review of development <br />applications subject to the standards and requirements of this Section; <br />and <br />• Establishes standards for the phasing, changes in site and development <br />design, or proffering of public facilities in order to establish <br />flexibility, avoid the unreasonable delay of development approval, and <br />to promote the County's planning policies. <br />School Adequacy Review <br />Acceptable Level of Service (LOS): 110$ Capacity <br />3 Levels of Review: <br />Level One - Existing Capacity: Current Enrollment vs. Existing <br />Capacity. If the number of empty seats is equal to or greater than the <br />number of students generated by the new subdivision, then adequate capacity <br />exists and the development may proceed. If capacity is not adequate, then; <br />Level Two - Two Years Planned Capacity: If the county capital <br />improvements program (CIP) shows school .capacity will be equal to or greater <br />than the projected enrollment that will be produced by the proposed <br />subdivision for all school types within two years, then "...the development MAY <br />be approved with conditions related to phasing or mitigation, and the <br />applicant shall be permitted to proceed through the development approval <br />process." If capacity is not adequate, then; <br />Level Three - Five Years Planned Capacity: If the county CIP shows <br />school capacity will be equal to or greater than the projected enrollment <br />that will be produced by the proposed subdivision for all school types within <br />five years, then the application can only be approved with the following <br />conditions: <br />
