The Board accepted the following recommendation as made by the Planning <br />Board pertaining to golf courses on page 126. <br /> <br />Golf Courses: A tract of land designated and laid out for the game <br />of golf, including accessory uses and buildings. <br /> <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Cook and <br />unanimously carried, the Board agreed to delete Paragraph B(3) of Subsection <br />9.8-22 Private Non-Commercial Airports of the original text of the proposed <br />ordinance. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Lentz and <br />unanimously carried, the Board approved the original text of the ordinance <br />for the definition of Lot, Non-Legal for Zoning Purposes on ~age 130. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Nash and <br />unanimously carried, the Board deferred action on the matter regarding the <br />definition for a "private street" until the Planning Director can confer with <br />the County Attorney regarding the definition of private street, dedicated <br />roadway, and possible conflict between definition used in Zoning Ordinance <br />and the definition for a private steet in the Cabarrus County Subdivision <br />Ordinance. <br /> The Board accepted the recommendations of the Planning Board for changes <br />on pages 114 and 115. <br /> UPON MOTION by Commissioner Cook, seconded by Commissioner Payne and <br />unanimously carried, the Board approved the addition of the following <br />subsection on page 82. <br /> <br />5.22-1 Expansion of I-X District. The existing operation within an <br />established I-X Zone is deemed to be a conforming use and therefore the <br />future expansion of this use is allowable upon approval by the Board of <br />Adjustment as is the case with any other established zone. <br /> <br /> UPON MOTION by Commissioner Nash, seconded by Commissioner Cook and <br />unanimously carried, the Board approved the addition of the following <br />subsection on page 82. <br /> <br />5.22-2 Conversion of I-X Property to Other Use. This conversion of <br />I-X property to another use may be affected provided that the Board <br />of Adjustment either by a general rule or specific findings in the <br />specific cases, shall find that the proposed' use is equally appropriate <br />or more appropriate for the district than the existing use. In <br />permitting such change, the Board of Adjustment may require appropriate <br />conditions and safeguards in accord with the general provisions of <br />conditional use and the ordinance. <br /> <br /> UPON MOTION hy Commissioner~ Nash, seconded by Commissioner Lentz and <br />unanimously carried, the Board approved the addition of the following <br />paragraph under Subsection 6.7 Nonconforming Uses of Major Structures~ or <br />Structures and Premises in Combination. <br /> <br /> E. If no structural alterations are made, any nonconforming use of <br /> a structure and premises, may as a conditional use be changed to <br /> another nonconforming use provided that the Board of Adjustment, <br /> either by general rule or bY making findings in the specific case, <br /> shall find that the proposed use is equally appropriate or more <br /> appropriate to'the district than the existing nonconforming use. <br /> In permitting such change, the Board of Adjustment may require <br /> appropriate conditions and safeguards in accord with the provisions <br /> of this ordinance. <br /> <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the Board deleted the heading for 9.4-2 with the <br />following paragraph to be included as a paragraph under 9.4-1 Application <br />Submitted to Zoning Official. <br /> <br /> The Zoning Official shall, within thirty (30) days of the receipt of <br /> the application, cause an analysis'to be made of the application and, <br /> based upon that analysis, prepare a recommendation for consideration by <br /> the Board of Adjustment. <br /> <br /> <br />
