5O5 <br /> <br />of a mobile home park on land previously platted for a subdivision. He <br />presented letters from Concord Engineering & Surveying, Inc., and <br />the Board of Light and Water Commissioners indicating~that· water and <br />sewer were available and feasible for the land. Mr. Plummer reported <br />that Mr. Faggart planned to develop a community water system and to <br />construct a holding tank at the City's Pump Station 2 located at the <br />intersection of Cold Springs Road and Mt. Pleasant Road to provide sewer <br />service for the land. In conclusion, Mr. Plummer stated the need for <br />more mobile home parks in the county because of high interest rates on <br />home loans and the rejection of a large percentage of septic tank permits. <br /> There was no one present to speak in opposition to the rezoning <br />request. <br /> During discussion of the petition, questions were raised regarding <br />the proposed sewer service for the property and spot zoning. <br />Commissioner Barnhardt asked Mr. Faggart if he were willing to run the <br />risk with his investments in the property if spot zoning were challenged <br />in court, and Mr. Faggart stated that he was. <br /> Motion was made by Commissioner Barnhardt and seconded by Commissioner <br />Milloway to approve Petition 84-04 rezoning the property to R-7.2 with <br />Commissioners Barnhardt and Milloway voting for and Commissioner Payne <br />and Chairman Lentz voting against. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner <br /> Payne and unanimously carried, the Board agreed for Petition 84-04 to <br /> come before the full Board at the regular meeting on March 5, 1984. <br /> <br />(6) <br /> <br />Petition 84-05, Niblock Construction, township 2 & 4, Highway 73 <br />West. Map/PIN township 2, 5611-23-1026, 13-0635, 5611(14)-22- <br />8096, 23-7219; township 4, 5611-14-7482. Wishes to rezone from <br />ARR/R-40 to R-15. Planning Board voted unanimous to approve this <br />request. <br /> <br /> Mr. Frank Niblock, III, spoke on behalf of Niblock Construction. <br />No one spoke in opposition to the rezoning request. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne <br />and unanimously carried, the Board approved Petition 84-05 submitted by <br />Niblock Construction Company to rezone Map/PIN township 2, 5611-23-1026, <br />13-0635, 5611(14)-22-8096, 23-7219; township 4, 5611-14-7482, from ARR/R-40 <br />to R-15. <br /> <br />ZONING TEXT AMENDMENTS <br /> <br />(1) <br /> <br />Permit churches as a right by use in commercial zoning districts <br />of C-3 and C-4. Page 12, Section 3.2-4. Planning Board unanimously <br />approved this text amendment. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board approved the proposed <br />text amendment, to permit churches as a right by use in the commercial <br />zoning districts of C-3 and C-4. <br /> <br />(2) Permit Multi~amily Dwellings and Single-Family Detached site <br /> built homes in the following commercial zoning districts: <br /> <br />Multi-Family Dwellings <br /> <br /> C-1 C-2 C-3 C-4 <br />p5 p5 p5 p5 <br /> <br /> Single-Family Detached <br /> <br />C-1 C-2 C-3 C-4 <br />p6 p6 p6 p6 <br /> <br />p5- must follow the RMF-7 Schedule of Development Standards, page 22, <br /> Section 3.2-4, must have direct access to public water and sewer. <br /> <br />p6_ must follow the most stringent residential lot size requirements <br /> within 500 feet of the commercial zone boundary. Planning Board <br /> unanimously approved this request. <br /> <br /> <br />
