Boger, Jr., County Attorney, read the following letter <br />from Mr. Clyde Propst, General Manager of the Cabarrus County Fair. <br /> <br />October 4, 1984 <br /> <br />Mr. John R. Boger, Jr. <br />County Attorney <br />Williams, Boger, Grady, Davis & Tuttle PA <br />147 Union Street South <br />Concord, North Carolina 28025 <br /> <br />Dear John, <br /> <br />Following our conversation this morning, regarding the Fair's use of some <br />eight acres of County land, at the rear of the Fairgrounds, please be <br />advised that the Fair will endeavor to maintain its premises in a reasonable <br />manner, insofar as building exteriors and mowing are concerned. We would <br />note that substantial funds were spent on these matters this year, which <br />effort we feel should be well received. <br /> <br />Further, the Fair will allow the Farmers' Market to use the Fair's Exhibit <br />Building, if desired, subject to such use not interfering with use by the <br />Fair, use by Cabarrus County Social Services for surplus commodity distri- <br />bution 4-H use, Bantam Assn. use, or customary use by other county depts., <br />and provided that the Farmers' Market and the county will insure (with <br />Fair as additional insured) and indemnify the Fair from risk of loss by <br />liability, or casualty (in amount of replacement cost of damaged buildings) <br />if loss occurs when Fair's property is used by Farmers' Market or county <br />depts. <br /> <br />In return, the County will lease the aforesaid tract to the Fair for a <br />12 month period beginning October 15, 1984; all such considerations to be <br />subject to annual renewal, only if acceptable to both parties (County and <br />Fair). <br /> <br />Thank you for your usual good cooperation. <br /> <br />Sincerely, <br />/s/ Clyde <br />CLYDE PROPST <br />General Manager <br /> <br /> Mr. John R. Boger, Jr., County Attorney, suggested that perhaps a lease <br />to the Fair as proposed in the letter should contain the provision that the <br />County would retain the right to use the eight acres of land so long as it <br />did not interfere with the Fair use during the week of the fair and perhaps <br />the week immediately before and after the fair. <br /> Commissioner Barnhardt objected to the proposal that the County will <br />provide insurance for the use of the Fair property by the Farmers' Market. <br />He stated that in his opinion the Fair property should have been used <br />for this purpose since 1955 as the Articles of the Deed for the property <br />states that the Fair Association will promote the sale of agricultural <br />products. The Board agreed to discuss this matter further at the next <br />Board meeting. <br /> Mr. Charles D. McGinnis, County Manager, reported that bids had been <br />received for the construction of the new National Guard Armory and that <br />a check in the amount of $53,750.44 had been forwarded to Raleigh to provide <br />the County's share of the construction cost. <br /> Commissioner Milloway presented a letter addressed to Mr. F. E. <br />Isenhour, Zoning Administrator, from Mr. Eugene Hermitte regarding the <br />noise at the Concord Speedway. <br /> There being no further business to come before the Board, the meeting <br />was adjourned at 9:30 P.M. <br /> <br />Clerk to the Board <br /> <br /> <br />
