163 <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Melvin and <br />unanimously carried, the Executive Session was terminated. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne and <br />unanimously carried, the Board adopted the following resolution. <br /> <br />As we have been having a number of contract discussions with the Town of <br />Harrisburg over rights and responsibilities under contracts now existing, <br />I would like to make a motion that we authorize the attorney for the <br />Board to initiate an action for declaratory judgment in order that we <br />may ask the local courts to determine each party's rights and responsi- <br />bilities under these contracts and that the parties in Harrisburg be <br />notified that this action is not actually a suit against them but merely <br />an action to clarify our status and their status in regard to those <br />contracts. <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz and unani- <br />mously carried, the Board adopted the following resolution. <br /> <br />As there are several tracts of land in the Coddle Creek Reservoir area <br />in which we have had no contact with the owners in a considerable amount <br />of time, I would ask that the attorney for the Board write to those <br />parties who have not had contact with him up to this point notifying <br />them that we do require their land and asking that they get in touch <br />with us and informing them that any parcel on which contact is not made <br />by September 1 will be subject to condemnation by the County. <br /> <br /> There being no further business to come before the Board, the meeting <br />adjourned at 12:55 P.M. <br /> <br />Clerk to the Board <br /> <br /> <br />
