244 "Health Director" - the director of the Cabarrus County Health Department or his authorized representative. "Board of Health" - the Cabarrus County Board of Health. "County Commissioners" the Board of Commissioners of Cabarrus County. SECTION II - GENERAL CONDITION Ail solid waste shall be stored, collected, transported, treated, utilized, processed, reclaimed, recycled and disposed of in a manner consistent with the requirements and intent of this ordinance. Notwithstanding other provisions of this ordinance, no radioactive solid waste shall be collected and transported, stored, treated, processed, or reclaimed, except as specifically authorized by a radioactive material license issued by the State Division of Facilities Services, Radiation Protection Branch. No radioactive solid wastes shall be disposed of in Cabarrus County without prior approval of the Health Director. Regulations pertaining to the management of solid waste may be promul- gated by the County Commissioners or the Board of Health. Not less than 10 days before the adoption, amendment or repeal of any local board of health rule, the proposed rule shall be made available at the office of each county clerk within the board's jurisdiction, and a notice shall be published in a newspaper having general circulation within the area of the board's jurisdiction. The notice shall contain a statement of the substance of the proposed rule or a description of the subjects and issues involved, the proposed effective date of the rule and a statement that copies of the proposed rule are available at the local health department. A local board of health rule shall become effective upon adoption unless a later effective date is specified in the rule. The Health Director shall be the primary official charged with the administration, supervision, execution and initial enforcement of regu- lations pertaining to the management of solid waste. SECTION III SOLID WASTE STORAGE No person owning or occupying any premises shall permit any solid waste to accumulate upon such premises that is not stored in a manner approved by the Board of Health. SECTION IV - SOLID WASTE REMOVAL The owner and occupier of all premises upon which garbage or other solid waste is stored shall remove or cause to be removed all such materials from their premises at least once a week. It shall be the specific responsibility of the owners of mobile home parks and apartment houses or complexes to provide for the collection and removal of all refuse from the premises at least once per week. Such mobile home parks and apartment complexes, when services are rendered to all residents pursuant to a single contract with the owner or manager thereof, shall be deemed to be a commercial venture for the purposes of Section X herein. SECTION V - SOLID WASTE TRANSPORTATION No person for hire shall transport solid waste in a conveyance that has not been inspected and approved by the Health Director and certified as being in compliance with rules promulgated by the Board of Health. SECTION VI - SOLID WASTE DISPOSAL No garbage or solid waste generated outside of Cabarrus County shall be disposed of in the county's landfill. No person shall dispose of solid waste except by one of the following methods: By burying in a sanitary landfill that is permitted by the Solid and Hazardous Waste Branch of the North Carolina Department of Human Resources. This ordinance shall not be construed to obstruct the recycling of garbage or solid waste.
