365 <br /> <br />10. <br /> <br />For preparing application forms and completing supporting data for <br />federal, state or local agencies, the Engineer will be paid by the Owner <br />based on the rates listed in Number 9. <br /> <br />Part V - General Conditions <br /> <br />Ail invoices for engineering services will be due within thirty (30) days <br />after the date of the invoice and no part shall be withheld on account of <br />delays or performance of Contractor, or to cover the cost of work not speci- <br />fied but which the Owner may consider necessary or desirable. <br /> <br />The Owner will provide such legal, accounting and insurance counseling <br />services as may be required for the project. <br /> <br />In accepting this Proposal, the Owner accepts all parts thereof, but perfor- <br />mance of each part shall be initiated as directed by the Owner in writing for <br />each miscellaneous project. <br /> <br />The plans and specifications will be completed by the Engineer within a <br />reasonable time. If the Owner wishes to terminate this contract before final <br />plans and specifications are completed, the Owner must inform the Engineer in <br />writing to terminate all work on project. The Owner will pay the Engineer on <br />an hourly basis for all work completed. <br /> <br />Since the Engineer has no control over the cost of labor, materials or equip- <br />ment, or over the Contractor's methods of determining prices, or over <br />competitive bidding or market conditions, the estimates of construction cost <br />provided for herein are to be made on the basis of his experience and <br />qualifications and represent his best judgment as a design professional <br />familiar with the construction industry, but the Engineer cannot and does not <br />guarantee that bids or the project construction cost will not vary from cost <br />estimates prepared by him. <br /> <br />ACCEPTED BY OWNER <br /> <br />/s/ James W. Earl Cochran & Son., Inc. <br />May 10~ 1988 <br />Date <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Melvin and <br />unanimously carried, the Board appointed Commissioner Giles Moss and Mr. <br />Thomas W. Dayvault, Executive Vice-President of the Kannapolis Chamber of <br />Commerce, to serve as the County's representatives on the Transportation Task <br />Force formed by the Carolina Counties Coalition. The purpose of the task <br />force is to determine a process for implementing a regional regional trans- <br />portation planning organization. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Hamby and <br />unanimously carried, the Board adopted a resolution assigning and directing <br />Ms. Derelle Kiser as Tax Collector to use all legal means to collect all <br />current and delinquent tax as provided for in General Statutes 105-366, 367, <br />and 368. Pilkington, Health Director, <br />because of the wide variation in the bids. <br /> <br /> <br />
