4O <br /> <br />Sewer Use Ordinance, connections to its wastewater collection system <br />so that all connections meet the requirements of the COUNTY's Sewer <br />Use Ordinance. <br /> <br />10) <br /> <br /> The staffs of the COUNTY and CONCORD shall meet and agree upon the <br />day to day procedures for the implementation of this agreement. <br />CONCORDts staff shall put the agreed upon procedure in writing and <br />submit to the COUNTY's staff for concurrence. <br /> <br />Section B- Surcharge Program <br /> <br /> CONCORD shall include in the Sewer Use Ordinance the allowable <br />treatment plant influent design discharge limits for BOD, COD, TSS and NH3. <br />Provided the Rocky River Regional Wastewater Treatment Plant has adequate <br />capacity and the capability to comply with the NPDES Permit, a non-domestic <br />discharger will be permitted to discharge in excess of the design limits <br />provided a surcharge is paid and there is no adverse impact on the Rocky <br />River Regional Wastewater Treatment Plant or its operation. <br /> <br />Section C- Compensation <br /> <br />1) <br /> <br /> CONCORD will establish the basis for a Surcharge Rate Structure <br />uniform throughout the systems of CONCORD and COUNTY and consistent <br />with current state and federal regulations. CONCORD will review and <br />update the surcharge rate as necessary to comply with the ordinance <br />and to recover all the cost incurred by the excess loadings (e.g. <br />Surcharge Fees), Any proposed changes and modifications to the <br />Surcharge Rate Structure will be reviewed with the COUNTY before <br />adoption. <br /> <br />2) <br /> <br /> CONCORD will include in and as a separate part of the Surcharge <br />Rate Schedule Program, a Rate Schedule which shall recover the cost <br />for administering and monitoring of the Pretreatment and Surcharge <br />Programs (e.g. Program Fees and Sample Fees). <br /> <br />3) <br /> <br /> The Rate Schedules for the Pretreatment and Surcharge Programs, <br />described in number 1 and 2, shall be reviewed by CONCORD annually to <br />insure that each non-domestic source is paying a reasonable fair <br />share. Each industry or non-domestic user, subject to the <br />Pretreatment and Surcharge Programs shall be billed directly by the <br />Rocky River Regional Wastewater Treatment Plant. Bills are payable <br />within 20 days from the billing date. <br /> <br /> The COUNTY agrees to provide the Rocky River Regional <br />Wastewater Treatment Plant with monthly water consumption data to be <br />used for monthly Surcharge Billing for each non-domestic user subject <br />to the Pretreatment and Surcharge Programs, in accordance with <br />CONCORDts Sewer Use Ordinance. <br /> <br /> Article II <br />Remedies For Non-compliance <br /> <br />1) <br /> <br />2) <br /> <br /> The COUNTY agrees to reimburse and hold harmless CONCORD from all <br />costs and damages to treatment works or disruption of treatment <br />processes or operations, including costs for sludge disposal, that may <br />result from any action by the COUNTY not in accordance with this <br />agreement and state and federal pretreatment regulations. <br /> <br /> CONCORD and the cOUNTY agree to not accept any wastewater from <br />any source, domestic or non-domestic, whose facilities do not meet all <br />State requirements concerning obtaining a permit prior to <br />construction. <br /> <br />3) <br /> <br /> The COUNTY agrees that CONCORD may impose fines upon dischargers <br />in violation of-standards and limitations and to support and consider <br />binding the enforcement procedures and action taken by CONCORD to <br />correct violations of CONCORD's Ordinance and Pretreatment Program, <br />provided such action and procedures are in accordance with "Section <br />12-67, Enforcement Procedures", of CONGORD's Sewer Use Ordinance. <br /> <br /> <br />
