4O Sewer Use Ordinance, connections to its wastewater collection system so that all connections meet the requirements of the COUNTY's Sewer Use Ordinance. 10) The staffs of the COUNTY and CONCORD shall meet and agree upon the day to day procedures for the implementation of this agreement. CONCORDts staff shall put the agreed upon procedure in writing and submit to the COUNTY's staff for concurrence. Section B- Surcharge Program CONCORD shall include in the Sewer Use Ordinance the allowable treatment plant influent design discharge limits for BOD, COD, TSS and NH3. Provided the Rocky River Regional Wastewater Treatment Plant has adequate capacity and the capability to comply with the NPDES Permit, a non-domestic discharger will be permitted to discharge in excess of the design limits provided a surcharge is paid and there is no adverse impact on the Rocky River Regional Wastewater Treatment Plant or its operation. Section C- Compensation 1) CONCORD will establish the basis for a Surcharge Rate Structure uniform throughout the systems of CONCORD and COUNTY and consistent with current state and federal regulations. CONCORD will review and update the surcharge rate as necessary to comply with the ordinance and to recover all the cost incurred by the excess loadings (e.g. Surcharge Fees), Any proposed changes and modifications to the Surcharge Rate Structure will be reviewed with the COUNTY before adoption. 2) CONCORD will include in and as a separate part of the Surcharge Rate Schedule Program, a Rate Schedule which shall recover the cost for administering and monitoring of the Pretreatment and Surcharge Programs (e.g. Program Fees and Sample Fees). 3) The Rate Schedules for the Pretreatment and Surcharge Programs, described in number 1 and 2, shall be reviewed by CONCORD annually to insure that each non-domestic source is paying a reasonable fair share. Each industry or non-domestic user, subject to the Pretreatment and Surcharge Programs shall be billed directly by the Rocky River Regional Wastewater Treatment Plant. Bills are payable within 20 days from the billing date. The COUNTY agrees to provide the Rocky River Regional Wastewater Treatment Plant with monthly water consumption data to be used for monthly Surcharge Billing for each non-domestic user subject to the Pretreatment and Surcharge Programs, in accordance with CONCORDts Sewer Use Ordinance. Article II Remedies For Non-compliance 1) 2) The COUNTY agrees to reimburse and hold harmless CONCORD from all costs and damages to treatment works or disruption of treatment processes or operations, including costs for sludge disposal, that may result from any action by the COUNTY not in accordance with this agreement and state and federal pretreatment regulations. CONCORD and the cOUNTY agree to not accept any wastewater from any source, domestic or non-domestic, whose facilities do not meet all State requirements concerning obtaining a permit prior to construction. 3) The COUNTY agrees that CONCORD may impose fines upon dischargers in violation of-standards and limitations and to support and consider binding the enforcement procedures and action taken by CONCORD to correct violations of CONCORD's Ordinance and Pretreatment Program, provided such action and procedures are in accordance with "Section 12-67, Enforcement Procedures", of CONGORD's Sewer Use Ordinance.
