183 Mr. William Alexander, attorney representing Mr. Harold Wilkinson, opposed Petition 89-04 and stated that farmers need to be able to utilize their property. Also speaking on behalf of Vulcan Materials, Mr. Alexander commented that the extraction of earth products should not be included as a non-permitted use in the ARR zoning. Ms. Jill Ray spoke in support of Petition 89-04. She specifically addressed the need for local control over the extraction of earth products. Ms. Monica Moss supported Petition 89-04 and asked that the extraction of earth products be removed from the ARR zone. Mr. Don Stafford, resident of the Poplar Tent area, asked that the seven items be removed from the ARR zone and stressed the importance of orderly growth in Cabarrus County. Mr. F. A. Rankin spoke against Petition 89-04. He stated in his opinion concerns relative to rock quarries should be addressed by the rezoning of specific property rather than penalizing those persons living in the ARR zone. Mr. Troy Cook, a farmer, objected to the removal of the permitted uses from the ARR zone. Mr. Dennis Shultz complained of the Martin Marietta operation in Cabarrus County and supported the removal of the extraction of earth products from the ARR zone. Mr. William Fitzhugh complained of blasting by Vulcan Materials and asked that the Board restrict those activities that are adverse for good growth. Mr. Kenny Morrison stated the need for additional County control over activities in the county. Mr. Jim Boger stated that Martin Marietta would support the ability of any individual to extract minerals or like products from his property. He further commented that the extraction of earth products should not be restricted to any specific location. There being no one else to speak regarding Petition 89-04, the public hearing was closed. UPON MOTION of Commissioner Moss, seconded by Chairman Lentz with Commissioners Moss and Melvin and Chairman Lentz voting for and Commissioners Hamby and Simmons voting against, the Board tabled Petition 89-04 relative to the removal of the seven items from the ARR zone for further study by the Planning Board. The seven items were as follows: (1) Extraction of Earth Products; (2) Machine Welding Shops; (3) Wooden Products Manufacturing; (4) Contractor Storage Yards; (5) Cotton Gins and Cotton Waste; (6) Meat Packing and Poultry Processing; (7) Saw Mills and Planing Mills. UPON MOTION of Commissioner Simmons, seconded by Commissioner Hamby with Commissioners Simmons, Hamby and Melvin voting for and Commissioner Moss and Chairman Lentz voting against, the Board moved to take the extraction of earth products off the table. The motion by Commissioner Simmons and seconded by Commissioner Hamby to amend the Zoning Ordinance to remove the extraction of earth products as a conditional use from the ARRzone subject to the bona fide farms exception failed with Commissioners Simmons and Hamby voting for and Commissioners Moss and Melvin and Chairman Lentz voting against. UPON MOTION of Commissioner Melvin, seconded by Chairman Lentz and unanimously carried, the Board moved to reconsider the denial of the petition as to the extraction of earth products. UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin and unanimously carried, the Board tabled Item 1, Extraction of Earth Products, of Petition 89-04 for further study by the Planning Board. Chairman Lentz opened the public hearing to consider the levy of a room occupancy and tourism development tax in Cabarrus County and asked if anyone were present who wished to speak regarding the proposed tax. Mr. Lester Stocks, President-Elect of the Kannapolis Chamber of Commerce, supported the proposed occupancy tax and stated in his opinion tourism is a desirable industry for Cabarrus County. Mr. Thomas W. Dayvault, Executive Vice-President of the Kannapolis Chamber of Commerce, requested the imposition of a three percent (3%) occupancy tax as soon as possible. Mr. Irvin Newberry, President of the Concord-Cabarrus County Chamber of Commerce, endorsed the proposed occupancy tax and the establishment of a Tourism Authority. He stated in his opinion that the Authority should be allowed to determine the location, personnel, and operation of the Tourism Authority office. Ms. Lynne Scott Safrit, Executive Vice-President of Atlantic American Properties, addressed the impact of tourism in Cannon Village and recommitted an earlier offer of space in Cannon Village for the location of the Tourism Authority facility.
