48 <br /> <br /> When a holiday other than Christmas Day falls on a Saturday <br />or Sunday, the County shall observe the same day as the State of <br />North Carolina observes for the holiday in question. <br /> <br /> If a holiday as designated by the County Personnel Ordinance <br />falls on a day other than Monday and is designated nationally to be <br />observed on a Monday, then the County policy is amended to observe <br />that holiday on a Monday. <br /> <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Carpenter and <br />unanimously carried, the Board added to the agenda a presentation by Mr. Larry <br />Cole from the Poplar Tent Community Association. <br /> Mr. Larry Cole, Chairman of the Poplar Tent Community Association, <br />reviewed a proposed bill to be entitled "An Act to Incorporate the Town of <br />Poplar Tent, Subject to a Referendum". He indicated the area proposed for <br />incorporation met the density requirements and that a majority of persons <br />surveyed in that area supported the incorporation effort and a recommended tax <br />of 15 cents per $100 valuation to fund services relating to planning and zoning, <br />water and sewer, garbage collection, increased police protection, and street <br />lights. Mr. Cole further stated that the airport was not an issue as it was <br />protected in the bill for incorporation and that there was no problem with the <br />proximity of the area to the cities of Concord and Kannapolis. In conclusion, <br />Mr. Cole asked that the Board send a letter to the County's legislative <br />delegation stating that the Board does not object to letting the people vote on <br />the incorporation bill. <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Hamby and <br />unanimously carried, the Board authorized the Chairman to send a letter to the <br />County's legislative delegation stating that the Board of Commissioners does not <br />oppose the introduction of the bill entitled "An Act to Incorporate the Town of <br />Poplar Tent, Subject to a Referendum" for the incorporation of the area known <br />as Poplar Tent. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart and <br />unanimously carried, the Board amended the previously adopted Personnel <br />Ordinance amendment relative to the holiday schedule and set an effective date <br />of January 1, 1992 for the new holiday schedule. <br /> Commissioner Barnhart and Mr. Hartsell reviewed the draft of the recall <br />legislation. Items discussed by the Board included the banning of a recall <br />during the first six months and last three months of office for the Board of <br />Commissioners, the posting of a $500.00 deposit to be returned upon validation <br />of petitions by the Board of Elections, a 60-day time frame to complete the <br />petitions, and a provision to allow for the appointment of members until a <br />special election can be held to fill a vacancy. Also, Mr. Hartsell suggested <br />that if the legislation is expanded to include other elected officials that the <br />proposed draft be forwarded to those officials for their review.
