UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart and unanimously carried, the Board rescheduled the first regular meeting in September from 6:30 P.M. on Monday, September 2, to 6:30 P.M. on Tuesday, September 3, due to the Labor Day holiday. Chairman Simmons recessed the meeting until the conclusion of the meeting of the Water and Sewer District Commissioners. Chairman Simmons reconvened the meeting of the Board at 8:15 P.M. INFORMAL PUBLIC COMMENTS Chairman Simmons opened the meeting for informal public comments. Mr. Austin Mitchell of Kannapolis presented a draft resolution relative to the pension fund for Cannon Mills retirees and the recent 30 percent reduction in their pensions due to the bankruptcy of Executive Life Insurance Company. Mr. Mitchell's resolution called for the following action: Therefore be it resolved: That the Cabarrus County Commission requests that the Insurance Commissioner of the State of North Carolina, to immediately raise funds for the purpose of insuring that all retirees, living within the border of the State of North Carolina, receive their full pensions and that the Insurance Commissioner seek to recover misused, lost or misplaced funds from sources responsible, and Therefore be it resolved: That the Cabarrus County Commission requests the Insurance Commissioner of the State of North Carolina to seek an amendment, to the present statutes, in the North Carolina General Assembly, guaranteeing 100 percent benefits, regardless of what chapter of the bankruptcy statutes the insolvent proceedings are filed, and regardless of the state the receivership is declared in. UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhart and unanimously carried, the Board instructed the County Attorney to prepare a resolution for the Board of Commissioners consistent with the draft resolution presented by Mr. Austin Mitchell. Each Board member is to individually sign the resolution prior to its being sent to the Insurance Commissioner. Further, the resolution is to be presented for formal adoption by the Board at its next meeting. OTHER BUSINESS Commissioner Carpenter announced that the North Carolina Department of Transportation will conduct a public hearing at the Harrisburg Elementary School on August 6 at 7:30 P.M. concerning the proposed widening of North Carolina Highway 49. Chairman Simmons announced that the next Public Affairs Bulletin would contain information regarding the Aging Department/Senior Center and the Fiscal Year 1991-1992 budget. He asked that each Board member review the draft of the newsletter, when completed, and return it to the Planning Department with any revisions. Chairman Simmons reported that the City of Kannapolis was interested in selling water to Cabarrus County and entering into a reciprocal agreement whereby the City and County could tap on to each other's system at no charge. This matter will be considered further at a later date. UPON MOTION of Chairman Simmons, seconded by Commissioner Carpenter and unanimously carried, the Board moved to go into executive session to discuss board appointments, land acquisition, consultation with counsel, personnel matters, and pending litigation.
