409 <br /> <br /> of treated water consumed by HARRISBURG'S customers in the <br /> area which it services and which have connected to and use <br /> such treated water provided by CABARRUS to HARRISBURG <br /> (b) For sewer: <br /> To quantify sewer discharges at points of connection to the <br /> other party's system, if required by standard engineering <br /> practices, law, regulations or other contractual agreement, <br /> the owner of an Existing Line may require a party seeking <br /> connection to install, at its sole expense, a metering station <br /> at a location approved by both HARRISBURG and CABARRUS at or <br /> near the point of connection of the Proposed Line to the <br /> Existing Line. The metering station itself shall consist of <br /> metering equipment approved by both HARRISBURG and CABARRUS. <br /> After connection, the metering equipment shall be owned by, <br /> and shall be maintained by the party providing service from <br /> the point of connection; NOTWITHSTANDING the foregoing, it is <br /> the desire and intent of HARRISBURG and CABARRUS to minimize, <br /> if not eliminate, the necessity for or usage of such meters <br /> wherever practicable. <br /> 7. Connection Fees. Except for any pre-existing contracts <br />or commitments of either HARRISBURG or CABARRUS which require <br />reimbursement of a portion of such fees collected, neither <br />HARRISBURG nor CABARRUS shall charge the other a fee for connection <br />to a water or sewer line of the other. (Insofar as the parties are <br />aware, the only such contracts or commitments existing at the time <br />of execution of this Agreement are those attached hereto marked <br /> "Exhibit A" and incorporated herein by reference.) 8. Service Areas and Backflow Prevention: <br /> (a) Service areas for both CABARRUS and HARRISBURG are <br /> defined and described in "Exhibit B" attached hereto and <br /> incorporated herein by reference, i.e. the Service Areas for <br /> the existing water and/or sewer system in place at the time <br /> the agreement is executed shall remain in effect. For <br /> existing or new customers, neither HARRISBURG nor CABARRUS <br /> shall make individual residential, commercial, and/or <br /> industrial connections to the other system's water and/or <br /> sewer lines, without the express, written permission of the <br /> other, which permission shall not be unreasonably refused. <br /> (b) New service areas are defined as those areas where <br /> service would be provided by either party with water and/or <br /> sewer lines not installed at the time the agreement is <br /> executed. Minimum connection requirements for extension of <br /> service areas are as follows: <br /> 1. Water: <br /> (a) 6-inch or larger as required to provide fire <br /> protection as per state standards. <br /> (b) 2-inch minimum to serve dead-end connections, <br /> maximum length of line and number of customers must meet <br /> state standards for proximity to facilities providing <br /> fire protection. <br /> 2. Sewer: <br /> No gravity sewer collection line less than 8-inch <br /> diameter. Interceptors and force mains shall be sized <br /> to meet state standards. <br /> (c) Any new connection off existing CABARRUS lines shall <br /> provide backflow prevention devices designed for the specific <br /> hazard and meeting the requirements of CABARRUS' Backflow <br /> Prevention Program. <br /> 9. User or Other Charges. Neither HARRISBURG nor CABARRUS <br />shall charge the other a "transit," "transportation," <br />"distribution," "maintenance," "user," or other such fee or charge <br />whether denominated as such or otherwise, for the use of the other <br />party's system for transportation, distribution, discharge or other <br />transmission of water or sewer. <br /> 10. Water/Sewer Rates. CABARRUS and HARRISBURG shall bill <br />customers within their individual service areas based on their <br />prevailing retail water and sewer rate schedule for the remainder of <br />their respective systems. <br /> <br /> <br />
