575 <br /> <br /> Commissioner Carpenter, serving in the capacity as Chair of the Cabarrus <br />County Board of Health, and Mr. Charles Phillips, Chairman of the Cabarrus County <br />Public Health Authority Board, presented the proposal to consolidate all public <br />health activities under one board. Members of the two boards voted on March 10, <br />1998 to recommend the immediate consolidation of the two boards under a Public <br />Health Authority as specified in SB 636 and for the existing Public Health <br />Authority Board to act as the local board of health. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Niblock with <br />Commissioners Barnhart, Niblock and Carpenter and Chairman Casper voting for, the <br />Board adopted the following Resolution. <br /> <br />Resolution No. 1998-19 <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br /> RESOLUTION ASSIGNING ADDITIONAL POWERS, DUTIES <br /> AND RESPONSIBILITIES TO THE <br />PUBLIC HEALTH AUTHORITY OF CABARRUS COUNTY, <br />MODIFYING THE MEMBERSHIP OF THE BOARD OF THE AUTHORITY <br /> AND DISSOLVING THE CABARRUS COUNTY BOARD OF HEALTH <br /> <br /> WHEREAS, by resolution dated the 6th day of May, 1997 (the ~Authorizing <br />Resolution'), the Cabarrus County Board of Commissioners: (a) established a <br />hospital authority (the 'Authority') under the provisions of N.C.G. 131E-15; (b) <br />vested in the Authority certain powers, duties and responsibilities formerly held <br />by the Cabarrus County Health Department; and (c) named the Authority the Public <br />Health Authority of Cabarrus County; and <br /> WHEREAS, subsequent to the adoption of the Authorizing Resolution, <br />Cabarrus County continued to operate a public health department governed by the <br />Cabarrus County Board of Health, the only powers, duties and responsibilities of <br />which were those statutory powers, duties and responsibilities specifically <br />required to be exercised by a local Board of Health; and <br /> WHEREAS, as authorized by the 1997 Session of the General Assembly, <br />effective January 1, 1998, subject to the approval of the State Health Director, <br />Cabarrus County may, by resolution, assign to the Authority those powers, duties <br />and responsibilities to provide public health services previously retained by the <br />Board of Health; and <br /> WHEREAS, Cabarrus County now desires to transfer the powers, duties and <br />responsibilities previously retained by the Board of Health to the Authority and <br />to dissolve the Board of Health. <br /> BE IT, THEREFORE, RESOLVED, by the Board of Commissioners of Cabarrus <br />County that, upon approval of the State Health Director: <br /> <br /> 1. Those statutory powers, duties and responsibilities previously <br /> retained by the Cabarrus County Board of Health regarding the <br /> administration of public health in Cabarrus County shall be and the <br /> same are hereby assigned to the Authority which shall henceforth <br /> exercise all powers, duties and responsibilities to provide public <br /> health services identified in N.C.G.S. 130A-l.1, or otherwise. <br /> 2. Henceforth, the Authority shall act as the local board of health for <br /> Cabarrus County. <br /> 3. The Cabarrus County Board of Health shall be and the same is hereby <br /> dissolved. <br /> 4. The Board of Directors of the Authority shall be reconstituted as <br /> follows: <br /> (a) One (1) member or designee, nominated by the Cabarrus County <br /> Board of Commissioners; <br /> (b) One (1) member, nominated by the Cabarrus County Medical <br /> Society; <br /> (c) One (1) member, nominated by the Cabarrus Physicians <br /> Organization; <br /> (d) One (1) member or designee, nominated by the NorthEast Medical <br /> Center Board of Trustees; and <br /> (e) Three (3) public members, not affiliated with the foregoing, but <br /> recommended by the nominees set forth above. <br /> 5.
