620 <br /> <br /> WHEREAS, Cabarrus County, North Carolina has constructed the Muddy Creek <br />Wastewater Treatment Plant; and <br /> WHEREAS, a collection network must be constructed to provide sanitary <br />sewer service to the crossroads of U.S. 601 and N.C. 24/27; and <br /> WHEREAS, the City of Concord Engineering Department has provided <br />engineering services and partial funding for the provision of sanitary sewer <br />service; and <br /> WHEREAS, private property owners have agreed to provide partial funding <br />for the provision of sanitary sewer service; and <br /> WHEREAS, the Cabarrus County Board of Commissioners has agreed to <br />provide the remaining necessary funding; and <br /> WHEREAS, sanitary sewer service will be available to additional <br />properties in the crossroads area and those property owners will not have <br />contributed to the expense of extending service. <br /> NOW, THEREFORE, be it resolved that the Cabarrus County Board of <br />Commissioners resolves: <br /> 1. That Cabarrus County supports the extension of sanitary sewer service <br />to the crossroads area of U.S. 601 and N.C. 24/27; and <br /> 2. That the Cabarrus County Board of Commissioners have provided the <br />necessary remaining funding to make the extension of services possible; and <br /> 3. That the Cabarrus County Board of Commissioners establish a <br />Crossroads Sanitary Sewer Service Availability Fee to obtain reimbursement of <br />Cabarrus County funding; and <br /> 4. That the Crossroads Sanitary Sewer Service Availability Fee shall be <br />collected by the following manner: <br /> a. A Crossroads Sanitary Sewer Service Availability Fee shall be <br /> required to be paid before any property or use may access the <br /> public sanitary sewer system in the crossroads area of U.S. 601 <br /> and N.C. 24/27. <br /> b. The availability fee shall be paid before any building permit may <br /> be issued for a use intended to be served by the sanitary sewer. <br /> c. That fee shall be calculated based upon the estimated sewer <br /> effluent of existing/proposed use and the date of issuance of the <br /> building permit or proposed date of connection to the system. <br /> d. The estimated effluent shall be calculated based upon N.C. State <br /> standards for estimating effluent based on use. That estimate <br /> shall be reduced by 25% to reflect local experience. The City of <br /> Concord Engineering Department shall be responsible for estimating <br /> effluent. In such cases, where there is no applicable use in the <br /> N.C. State standards, the City of Concord may use a comparable <br /> local use to estimate effluent. Estimates shall be in gallons per <br /> day. <br /> e. The availability fee shall then be calculated based on a cost per <br /> gallon of effluent with that cost increasing with time. <br /> f. The cost/gallon fee schedule will be determined by the date of <br /> issuance of building permit and/or request to connect to the <br /> sanitary sewer system and shall be as follows: <br /> (1) The availability fee will be $5/gallon expected effluent for <br /> all connections before December 31, 1998. <br /> (2) The availability fee will be $6/gallon expected effluent for <br /> ~ all connections made between January 1, 1999 and July 1, 1999. <br /> (3) The availability fee will be $7/gallon expected effluent for <br /> connections made between July 1, 1999 and June 30, 2000. <br /> (4) The availability fee will be $8/gallon expected effluent for <br /> on connections made July 1, 2000. <br /> g. The existing Muddy Creek Drainage Basin Availability Fee adopted <br /> by the Board of Commissioners on February 6, 1995 shall not be <br /> charged on any development subject to the Crossroads Sanitary <br /> Sewer Service Availability Fee. <br /> <br />Adopted this the 15~hday of June, 1998. <br /> <br /> /s/ Sue B.
