<br /> WHEREAS, in January, 1981, the Counties established Bakers Creek Park
<br />(the "Park") upon the Real Property; and
<br /> WHEREAS, on August 17, 1998, the Cabarrus County Board of Commissioners
<br />and the Rowan County Board of Commissioners entered into an agreement (the
<br />"Agreement") with the City of Kannapolis whereby the ownership of the Park
<br />was to be transferred to the City under certain specified conditions,
<br />including providing for a reduction of budget funding by the Counties; and
<br /> WHEREAS, under the Agreement, Rowan County did agree to appropriate and
<br />contribute funding in the sum of $21,918.00 for the fiscal year 1998-1999
<br />operating budget of the Park and thereafter to assume no other obligations
<br />relating to the Park, its facilities or operations except as may otherwise be
<br />approved by the County; and
<br /> WHEREAS, under the Agreement, Cabarrus County did agree to appropriate
<br />and contribute funding to the annual operating budget of the Park as follows:
<br /> (1) fiscal year 1998-1999 ........... $48,850.00
<br /> (2) fiscal year 1999-2000 ........... $32,567.00
<br /> (3) fiscal year 2000-2001 .......... $16,284.00
<br />and thereafter to assume no other obligations relating to the Park, its
<br />facilities or operations; and
<br /> WHEREAS, pursuant to the Agreement, the Counties agreed to execute
<br />deeds for the Real Property and transfer documents for personal property as
<br />may be necessary and appropriate for the transfer of fee simple title to the
<br />Park, its facilities and related personal property free and clear of all
<br />liabilities, claims, obligations, security interests and encumbrances; and
<br /> WHEREAS, beginning on January 1, 1999, the City of Kannapolis, under
<br />the provisions of the Agreement did agree to act as lead agency for the
<br />management and operation of the Park which activities shall include, but
<br />shall not be limited to, the following:
<br /> (a) Acting as the Park's purchasing agent for all supplies,
<br /> (b) Providing accounting and other fiscal control in compliance with
<br />those procedures identified in North Carolina General Statutes Chapter 159,
<br /> (c) Providing an annual audit of the Park's budget and expenditures
<br />as required by the North Carolina Local Government Commission,
<br /> (d) Providing or performing such other services and activities as the
<br />City and Cabarrus County may agree; and
<br /> WHEREAS, the Park Commission was greatly aided in its efforts to
<br />establish the Park through two Federal Grants for Capital Improvement from
<br />the Land and Water Conservation Funds of the United States Department of
<br />Interior and the National Park Service as well as a State Grant for Capital
<br />Improvement from the North Carolina Parks and Recreation Trust Fund; and
<br /> WHEREAS, the Cannon Mills Company generously donated a substantial
<br />portion of real property used by the Park Commission to establish the Bakers
<br />Creek Park; and
<br /> WHEREAS, Atlantic American Properties generously donated a substantial
<br />portion of real property used by the Park Commission to establish the Bakers
<br />Creek Greenway; and
<br /> WHEREAS, the leadership and support of the members of the
<br /> Cabarrus-Rowan Park Commission has been invaluable in the successful
<br /> culmination of this project; and
<br /> WHEREAS, the financial support provided by the Federal and State
<br />grants, the combined support of Cabarrus County, Rowan County and the City of
<br />Kannapolis together with the generosity of private companies, businesses,
<br />non-profit organizations and the support of the general public serves as an
<br />excellent example of what can be accomplished when the public and private
<br />sectors work together for a common goal;
<br /> NOW, THEREFORE, BE IT RESOLVED, by the Boards of County Commissioners
<br /> of Cabarrus County and Rowan County as follows:
<br /> 1. The Cabarrus-Rowan Park Commission is hereby terminated in
<br /> accordance with the Agreement.
<br /> 2. The members of the Park Commission are commended for the work they
<br /> have done in bringing this project to its fruition.
<br /> 3. The enjoyment that each of these individuals has expressed in seeing
<br /> Bakers Creek Park and the Bakers Creek Greenway become a reality is duly
<br /> noted as is their collective appreciation to the City of Kannapolis for
<br /> ensuring the continued success of the fruits of their labor.
<br /> 4. This Resolution shall become effective upon its adoption.
<br /> Adopted this 21st day of September, 1998.
