It is not the intention to repeal, but rather to re-enact and continue in force such existing provisions so that all rights and liabilities that have accrued there under are preserved and may be enforced. All provisions of the Subdivision Ordinance, which are not re-enacted herein are hereby repealed. All suits at law for inequity and/or all prosecutions resulting from the violation of any subdivision ordinance heretofore in effect, which are now pending in any of the courts of this state or of the United States shall not be abated or abandoned by reason of the adoption of this ordinance, but shall be prosecuted to their finality the same as if this ordinance had not been adopted, and any and all violators of the existing ordinance prosecutions for which have not yet been instituted may be hereafter filed and prosecuted, and nothing in this ordinance shall be construed as to abandon, abate, or dismiss any litigation or prosecution, now pending and/or which may heretofore have been instituted or prosecuted. The Ordinance Amending the Cabarrus County Zoning ordinance as adopted by the Board is as follows: Petition C04-04 (T) Ordinance No. 2004-14 D~N ORDINA/~CE AMENDING THE CkBD~RRUS COUNTY ZONING ORDIND~NCE BE IT ORDAINED that the Cabarrus County Zoning ordinance is hereby amended as follows: A) CHAPTER SIX: GENERAL REQUIREMENTS/EXCEPTIONS ~ MODIFICATIONS. 1) Renun~er section 6-13 to section 6-14 2) Add new section 6-13 as follows: Developments in the General Commercial and Limited Commercial Zoning Districts shall be required to provide sidewalks in the following locations: a) On one side of all public streets directly adjacent to the developed site; b) On both sides of all interior public streets within the development; C) Within the development to link buildings with the following: i) ii) iii) iv) Parking Adjoining streets Adjoining sidewalks Adjoining developments or amenities where appropriate pedestrian connections should be reasonably accomplished A waiver from the sidewalk requirements may be granted by the Zoning Administrator where the installation would not be reasonably tied to an existing or planned pedestrian network.
