July 26, 2004 Page 557 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session in the Commissioners' Meeting Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Monday, July 26, 2004, at <br />6:30 p.m. <br /> <br />Present - Chairman: Robert M. Freeman <br /> Commissioners: Carolyn B. Carpenter <br /> Robert W. Carruth <br /> <br />Absent - Vice Chairman: Richard D. Suggs <br /> Commissioner: Coy C. Privette <br /> <br /> Also present were John D. Day, County Manager; Marilyn D. Porter, <br />County Attorney; Frankie F. Bonds, Clerk to the Board; and Kay Honeycutt, <br />Deputy Clerk to the Board. <br /> <br /> Chairman Freeman called the meeting to order via speaker telephone from <br />NorthEast Medical Center at 6:32 p.m. He expressed thanks for all the <br />outpouring of support that he and his family had received during his recent <br />heart surgery. <br /> <br />Designation of Acting Chairman <br /> <br /> UPON MOTION of Chairman Freeman, seconded by Commissioner Carpenter and <br />unanimously carried, the Board voted for Commissioner Carruth to serve as <br />Chairman for the duration of the July 26tn meeting. <br /> <br /> Acting Chairman Carruth expressed well wishes to Chairman Freeman for a <br />speedy recovery. He reported that Vice Chairman Suggs was ill and <br />Commissioner Privette was in China. <br /> <br /> Acting Chairman Carruth read the following excerpt from North Carolina <br />General Statute (NCGS) 153A-43: <br /> <br />A majority of the membership of the Board of Commissioners <br />constitutes a quorum. The number required for a quorum is not <br />affected by vacancies. If a member has withdrawn from a meeting <br />without being excused by a majority vote of the remaining members <br />present, he shall be counted as present for the purposes of <br />determining whether a quorum was present. <br /> <br /> Ms. Porter stated NCGS 143-318.13 enables Board members to participate <br />in a Board meeting by electronic means. <br /> <br />Flag Ceremony and Invocation <br /> <br /> Girl Scout Cadette Troop 226 of the Cold Springs United Methodist <br />Church conducted the Flag Ceremony. Scouts participating in the ceremony <br />were Kelby Hurlocker, Hillary Fearrington and Casey Honeycutt. <br /> <br /> Reverend Raymond Davis of Solid Rock Worship Center gave the <br />invocation. <br /> <br />(A) APPROVAL OR CORRECTION OF MINUTES <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Acting Chairman <br />Carruth and unanimously carried, the Board approved the minutes of May 31, <br />2004 (Recessed Meeting), June 7, 2004 (Recessed Meeting), June 8, 2004 <br />(Recessed Meeting), June 14, 2004 (Recessed Meeting) and the June 15, 2004 <br />(Regular Meeting) as written. <br /> <br />(B) APPROVAL OF THE AGENDA <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Acting Chairman <br />Carruth and unanimously carried, the Board approved the Agenda with Item <br />as the first item. <br /> <br />NEW BUSINESS <br /> <br />(G-2) Resolution Approving the Filing of an Application with the Local <br />Government Commission, Authorizing Publication of a Notice of Intent to File <br />Said Application and Finding the Need for Pro~ects to be Financed by the <br />Issuance of General Obligation Bonds Consisting of $94,900,000 School Bonds <br />and $3,100,000 Community College Bonds <br /> <br /> <br />
