July 26, 2004 Page 578

The County is required by NCGS 159-30 to safeguard its investment
instruments with a fiscal agent or trustee. At its April meeting, the Board
awarded its banking contract to Bank of America. Part of that award was for
Safekeeping Services with Bank of New York Trust Company acting as trustee
for the County's investments. Bank of New York meets all the requirements of
the Local Government Commission.

UPON MOTION of Commissioner Carpenter, seconded by Acting Chairman
Carruth and unanimously carried, the Board approved the Custody Agreement for
Securities with the Bank of New York Trust Company, subject to final review
by the County Attorney; authorized the Deputy County Manager/Finance
Director, Assistant Finance Director, Accounting Operations Supervisor and
the Budget Officer to deliver oral and written instructions to the Bank of
New York pursuant to the Custody Agreement; and authorized the Deputy County
Manager/Finance Director to execute the Agreement on behalf of Cabarrus
County.

ITEM REMOVED FROM THE CONSENT AGENDA FOR DISCUSSION

(F-11) Selection of Stark Associates as HOME Program Administrator

Jonathan Marshall, Commerce Director, reported that Requests for
Proposals for HOME Program Administration were extended to four Community
Development consultants and posted on the County's website. The County
received only one proposal, which was from Stark Associates. The proposal was
for $15,545.00 of administration, in addition to five percent of the
rehabilitation budget.

UPON MOTION of Commissioner Carpenter, seconded by Acting Chairman
Carruth and unanimously carried, the Board selected Stark Associates to
administer the HOME Program and approved the contract subject to review and
changes by the County Attorney.

(G) NEW BUSINESS

(G-l) Report and Recommendations of the Cabarrus County Animal Control and
Preservation Task Force

Commissioner Carpenter recognized the Animal Control and Preservation
Task Force members and expressed appreciation for their hard work and service
to the County. The Task Force was established by the Board in 2003 to study
animal control issues, including the problem of pet overpopulation and
growing euthanasia rates.

Dr. Stewart Roberts, Chairman of the Cabarrus Animal Control and
Preservation Task Force, presented the findings and recommendations from the
Task Force. He reviewed the following problems that had been identified by
the Task Force and the recommended solutions to avoid future cost and
suffering:

(1)

Poverty level or struggling families/persons: Solution: Auxiliary
spay/neuter program.

For the elderly, low income, single parent or families qualifying
for public assistance (food stamps), six veterinarians in the
local area have agreed to provide an auxiliary spay/neuter
service to qualified indigent persons/families at an average cost
of $50 per animal.

The six veterinarians could perform as many as 40 surgeries per
month at the average cost of $50 per procedure. This would
require funding of $24,000 per year. Jim Cook, at the Department
of Social Services, has agreed to render the vouchers for the
approved indigent pet owner. Payments of the used vouchers would
be paid by the County if the State money was not available to
reimburse the veterinarians. All other pet owners and rescue
groups have the option of paying to use a low-cost spay neuter
program or through their local veterinarians.

Funding sources include: (1) the allocation of all animal control
violation revenues back to Animal Control to fund the auxiliary
spay/neuter and education program; and (2) State funds collected
from the wi Care" license tag sales and renewals.
