August 16, 2004 Page 596 <br /> <br />PURPOSE OF REQUEST: The 4-H Afterschool Program has applied for and. received <br />a $105,000 grant to assist With the expansion of three sites that offer 4-H <br />Afterschool. These sites include: Bethel Kids:Plus, Harrisburg Kids:Plus, <br />and Kids'Corner. At the Board' s request, Senator <br />Fletcher Hartsell introduced the legislation in the General Assembly and <br />Session Law 2003-81 (Senate Bill 425) was enacted on May 27, 2003. The <br />proposed ordinance authorizes Cabarrus County to begin using the Internet to <br />provide notice of public hearings in lieu of publication in the newspaper. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board adopted the following Ordinance: <br /> Ordinance No. 2004-17 <br /> AN ORDINANCE AUTHORIZING THE COUNTY OF CABARRUS TO USE <br /> ELECTRONIC MEANS TO PROVIDE PUBLIC NOTICE <br /> IN LIEU OF PUBLICATION <br /> <br /> WHEREAS, the County of Cabarrus holds a number of public hearings on a <br />variety of issues each year; and <br /> <br /> WHEREAS, North Carolina General Statute 1-597 requires that a notice or <br />legal advertisement of a-public hearing be published or advertised in a <br />newspaper having general circulation within the County; and <br /> WHEREAS, Session Law 2003-81 ratified on May 27, 2003 by the North <br />Carolina General Assembly, authorizes the County of Cabarrus to adopt <br />ordinances providing that legal notice of public hearings may be published <br />through electronic means in lieu of publication in any newspaper; and <br /> WHEREAS, the use of electronic advertising will provide a more <br />effective means of notifying the citizens of Cabarrus County of scheduled <br />public hearings. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Cabarrus County Board of <br />Commissioners that: <br /> <br /> (1) Legal notice of public hearings for the County of Cabarrus may be <br /> published through electronic means in lieu of publication in a <br /> newspaper; and <br /> (2) The types of hearings for which notices may be electronically <br /> published include, but are not limited to, those hearings <br /> required by law, such as those on the budget ordinance, bond <br /> ordinance, economic development purposes, or a zoning ordinance <br /> or amendments thereto; those hearings required in conjunction <br /> with the award of State and/or Federal grants; or those hearings <br /> held on the Board's own initiative to give interested citizens an <br /> opportunity to present their views on specific issues; and <br /> (3) The electronic publication of the public hearing notices may be <br /> on the County's Internet site or any other means, including but <br /> not limited to, the local government cable television channel; <br /> and <br /> (4) The notices published by electronic means shall state the <br /> subject, date, time and location of the public hearing and shall <br /> be posted a minimum of ten (10) days prior to the public hearing, <br /> or other such publication schedule required by State law, and <br /> shall remain posted until the day after the close of the public <br /> hearing; and <br /> <br /> <br />
