August 16, 2004 Page 584 <br /> <br /> Harold Smith, resident of 108 Edinburg Drive, Kannapolis, stated he was <br />confused about the proposed changes to the Economic Development Corporation <br />and asked for more details about the matter. <br /> <br /> Marcella Smith, resident of 108 Edinburg Drive, Kannapolis, expressed <br />appreciation for the opportunity to speak to the Board regarding County <br />business. She spoke of her recent encounter with a female Russian guide who <br />was reluctant to speak openly to Americans in public for fear of retribution. <br />Ms. Smith encouraged all Cabarrus County residents to attend Commissioners' <br />meetings and share their thoughts and feelings. <br /> <br /> Mike Helms, resident of 7900 Malibu Road, Mt. Pleasant, requested the <br />individual's name involved with the $130;000.00 settlement by the County. <br /> <br />(E) OLD BUSINESS <br /> <br />(E-l) Sale of Property (2.080 Acres) at the Old County School Administrative <br />office to Carolina Radiator & Air Cond~tionin~ Supply - Public Hearing - 6~30 <br /> <br /> Jonathan Marshall, Commerce Director, reported the Board had agreed in <br />principle to sell 2.080 acres of real property located at 660 Concord Parkway <br />North in Concord to Carolina Radiator & Air Conditioning Supply. He stated <br />pursuant to NCGS 158-7.1 a public hearing was required for that sale to be <br />completed through private negotiation. <br /> <br /> At 6:55 p.m., Chairman Freeman opened the public hearing on the sale of <br />2.080 acres of real property to Carolina Radiator & Air Conditioning Supply. <br />The Public Hearing Notice was published in THE INDEPENDENT TRIBUNE on August <br />4, 2004. <br /> <br /> There was no one present to address the Board, and Chairman 'Freeman <br />closed the public hearing. <br /> <br /> UPON <br />Carpenter <br />Resolution: <br /> <br />MOTION of Commissioner Privette, seconded by Commissioner <br />and unanimously carried, the Board adopted the following <br /> <br /> Resolution No. 2004 - 27 <br /> <br /> RESOLUTION OF <br /> CABARRUS COUNTY, NORTH CAROLINA <br /> APPROVING THE AGREEMENT FOR PURCHASE D/qD SALE WITH <br /> CAROLINA RADIATOR & AIR CONDITIONING SUPPLY, INC. <br /> <br /> WHEREAS, Cabarrus County, North Carolina (the ~County") is a fully and <br />regularly created, organized and existing corporation of the State of North <br />Carolina, existing as such under and by virtue of the Constitution, statutes <br />and laws of the State of North Carolina; and <br /> <br /> WHEREAS, the Cabarrus County Board of Commissioners (~Commissioners") <br />has the power, pursuant to North Carolina General Statutes, Section 158-7.1 <br />to convey interests in property by private negotiation and may subject the <br />property to such covenants, conditions and restrictions as the County deems <br />to be in the public interest or necessary to carry out the purposes of that <br />Section; and · <br /> <br /> WHEREAS, the Commissioners hereby determine that the sale to Carolina <br />Radiator & Air Conditioning Supply, Inc. (the ~Purchaser") of approximately <br />2.080 acres of the former Cabarrus County School Administrative Complex <br />property (the ~Project") will stimulate the local economy, promote business <br />and result in the creation of a substantial number of jobs in the County; and <br /> <br /> WHEREAS, for the purpose of accomplishing the sale of the Project, the <br />Commissioners have determined that it is in the best interest of the County <br />that the County and the Purchaser enter into an Agreement for Purchase and <br />Sale of Real Property dated on or about July 29, 2004, (the ~Contract") to <br />provide for the sale by the County to the Purchaser of the Project; and <br /> <br /> WHEREAS, the commissioners hereby determine that a public hearing <br />concerning the proposed sale of the Project to. the Purchaser, after <br />publication of notice with respect to such public hearing, was duly held on <br />August 16, 2004, at 6:30 p.m. in the Commissioners Meeting Room, Cabarrus <br />County Governmental Center, 65 Church Street, SE, Concord, North Carolina; <br />and <br /> <br /> <br />
