September 20, 2004 Page 623 UPO~ MOTIO~ of Commissioner Carpenter, seconded by Commissioner Privette and unanimously carried, the Board scheduled a public hearing for the October meeting to consider amendments to the Zoning Ordinance to make mobile home parks and multifamily developments subject to the Adequate Public Facilities Ordinance. Chairman Freeman expressed appreciation to Commissioner Carruth for his presentation. He reaffirmed his support of the bond referendum, stating he had said at the August meeting that ~we should support this bond." Also, he expressed concern that some school personnel were ~downing" the bonds. Chairman Freeman made a motion to adopt the Resolution to Create a Policy for the Advancement of School' Adequacy with the advancement value of $4,034.00 and the development of a grant program for low-income and senior citizens. Commissioner Privette seconded the motion. Commissioner Carruth asked that the Resolution be amended to include a provision that the capital cost and required value of contribution would be indexed annually to reflect the change in cost of school construction. Chairman Freeman accepted the amendment. Vice Chairman Suggs stated opposition to the proposed $4,034.00 per lot, stating it would be detrimental to the building industry and associated building trades. He questioned the legality of the adequacy requirement and cautioned of potential lawsuits. Jonathan Marshall, Commerce Director, explained the review of subdivisions for school adequacy and also addressed the issue of vested rights. UPO~ MOTION of Chairman Freeman, seconded by Commissioner Privette with Chairman Freeman, Commissioners Carruth, Carpenter and Privette voting for and Vice Chairman Suggs voting against, the Board adopted the following Resolution to Create a Policy for the Advancement of School Adequacy with the capital cost and required value of contribution to be indexed annually. Further, a grant program is to be developed to make available a grant equal to 100 percent of the value of adequacy advancement to those who qualify for assistance from Habitat for Humanity, Prosperity Unlimited (formerly Cabarrus Community Development Corporation) or any other HUD-approved community housing organization and to the elderly who qualify for Homestead Exemption. Resolution to Create a Policy for the Advancement of School Adequacy Resolution No. 2004-37 WHEREAS, the Cabarrus County Board of Commissioners have put children first through the funding of construction of nine elementary schools, four middle schools, one high school and numerous additions and improvements to existing schools over the last fifteen years; and WHEREAS, the development and homebuilding industries are an important part of the local economy; and WHEREAS, a study by Tischler and Associates for Cabarrus County in 1996 found that the direct school capital cost incurred by the County is $8067 per unit for houses in transitional areas; and WHEREAS, new homes constructed in these developments will be subject to property taxes which in part will offset the incurred capital cost; and WHEREAS, new development continues to be approved within the unincorporated areas of Cabarrus County after a review of the adequacy of services based on the Cabarrus County Subdivision Regulations Chapter 4, Section 17 "Adequate Public Facilities Standards"; and WHEREAS, the Board of Commissioners is interested in approving new development that participates in the advancement of school adequacy; and WHEREAS, the Board of Commissioners would like for all new residential development in both the incorporated and unincorporated areas of Cabarrus County to be reviewed for school adequacy. NOW THEREFORE BE IT RESOLVED, by the Board of Commissioners of Cabarrus County that shall adopt the following policy to address school adequacy when reviewing new residential develo'~ment:
