October 4, 2004 Page 644 <br /> <br />Resolution Authorizing Condemnation to Acc~uire Certain P~o~ert~ of Johnny.'s <br />LLC for Im~rovlng Access to Harris Road'Middle School <br /> <br /> Mr. Day reported an additional 0.55 acre right-of-way is needed to <br />improve the access to the Harris Road Middle School and that all attempts of <br />negotiation had failed. The Board of Education, at its September meeting, <br />adopted a resolution authorizing the condemnation of 0.55 acre (Tax ID# 4681- <br />23-9931) belonging to Johnny's LLC. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner <br />Privette and unanimously carried, the Board adopted the following resolution <br />authorizing the condemnation to acquire certain property of Johnny's LLC: <br /> <br />Resolution No. 2004-39 <br /> <br />A RESOLUTION AUTHORIZING CONDEMNATION TO ACQUIRE <br /> CERTAIN PROPERTY OF JOHNNY'S LLC <br /> <br /> WHEREAS, the Cabarrus County Board of Education and the <br />Cabarrus County Board of Commissioners (the ~Boards") hereby <br />determine that it is necessary and in the public interest to <br />acquire certain property which may be owned by Johnny's LLC, for <br />the following purpose: <br /> <br /> To expand and enhance the facilities available for the <br />children of Cabarrus County, including access to those <br />facilities; and more specifically, for improving access to Harris <br />Road Middle School for the safety both of the students and the <br />general public. <br /> <br /> WHEREAS, the proper officials or representatives of the <br />Boards have been unable tO acquire the needed interest in this <br />property by negotiated conveyance. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CABARRUS COUNTY BOARD <br />OF EDUCATION and the CABARRUS COUNTY BOARD OF COMMISSIONERS that: <br /> <br />The Boards shall acquire by condemnation, for the <br />purposes stated above, the property and interest <br />described in the attached Right-of-Way Plat (the <br />"Property") which, arguably, may be located in or <br />under Harris Road, Cabarrus'County, NC. <br /> <br />2 o <br /> <br />Attorneys representing the Boards are directed to <br />institute the necessary proceedings under Chapter 40A <br />of the North Carolina General Statutes to acquire the <br />Property. <br /> <br />Adopted: This 13tn day of September, 2004. <br /> <br />ATTEST: <br />/s/ Harold Winkler <br /> <br />Secretary <br /> <br />CABARRUS COUNTY BOARD OF EDUCATION <br />By: /s/ Elizabeth F.
