October 18, 2004 <br />(J) GENERAL CONNENTS HY HOARD N8N88R8 <br />Page 666 <br />Commissioner Carpenter commented on the change in membership of the <br />Community Committee on Education Capital Planning and Financing, the Board's <br />decision to enact the $4,034.00 adequacy requirement and the availability of <br />affordable housing in Cabarrus County. She stated support of the school bond <br />referendum and the importance of voting. <br />Economic Development Corporation <br />Commissioner Privette questioned the status of the budget for the <br />Economic Development Corporation (EDC). <br />John Day, County Manager, reported the EDC's budget had not yet been <br />completed. He stated it would be ready for presentation at a future Board <br />meeting. <br />(K) DVATBR & SEWER DISTRICT OF CABARRIIS CODNTY - RBGIILAR NESTING <br />DPON NOTION of Commissioner Carruth, seconded by Commissioner Carpenter <br />and unanimously carried, the Board recessed the meeting of the Hoard of <br />Commisaionera at 8:57 p.m. until the conclusion of the meeting of the Water <br />and Sewer District. <br />IIPON NOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board reconvened the regular meeting <br />of the Board of Commisaionera at 9:00 p.m. <br />(L) CLO88D S88SION <br />DPON NOTION of Commissioner Carruth, seconded by Commissioner Carpenter <br />and unanimously carried, the Hoard moved to go into Closed Session to consult <br />with the County Attorney in order to preserve the attorney-client privilege <br />and discuss pending litigation (Craft Development and Craft Homes va. the <br />County and Morrison va. the County) as authorized by North Carolina General <br />Statute (NCGS) 143-318.11(a)(3). The Board invited Martin Reidinge r, Esquire, <br />outside counsel for the County in the above-referenced litigation to join the <br />Board in Closed Session. Also, the Board will be updated regarding the status <br />of Systel Business Systems ve. Cabarrus County. <br />UPON NOTION of Commissioner Carpenter, seconded by Commissioner <br />Privette and unanimously carried, the Board voted to come out of Closed <br />Session at 10:19 pm. <br />No action was reported from the Closed Session. <br />(N) RECESS OF NESTING <br />There being no further business to come before the Board, Chairman <br />Freeman recessed the meeting at 10:20 p.m. until 4:00 p.m. on November e, <br />2004 in the Cabarrus Room at the Arena and Events Center. <br />Clerk to the Hoard <br />1 <br />1 <br /> <br />
