Organizational Meeting - December 6, 2004 Page 9 vice Chairman Carruth made a motion, seconded by Commissioner Juba, to adopt the Memoranda with the City of Kannapolis and the Town of Harrisburg along with the Memorandum with the City of Concord. There was additional discussion regarding the drafting of the Memoranda, specifically the involvement of the County Attorney and changes that had been made to the document. Mr. Day clarified that the consulting attorney had drafted the document. Martin Reidinger addressed the Board from the audience. He stated he was not sure which document the Board had before it for consideration, but the draft given to him by Mr. Day that afternoon was not the one that he and Ms. Porter prepared. However, Mr. Reidinger said there were some points included in the document that he and Ms. Porter had suggested. Chairman Carpenter called for a vote on Vice Chairman Carruth's motion. The motion to adopt the following and the Town of Harrisburg along with the ci ty of Concord carried with vice and Commissioner Juba voting for and voting against. Memoranda with the City of Kannapolis the Memorandum of Understanding with Chairman Carruth, Chairman Carpenter Commissioners Freeman and Privette STATE OF NORTH CAROLINA COUNTY OF CABARRUS MEMORANDUM OF UNDERSTANDING THIS MEMORANDUM OF UNDERSTANDING is made and entered into on this, the date shown at the conclusion of this document by and between Cabarrus County, a body politic and corporate of the State of North Carolina ("County") and the City of Kannapolis, a North Carolina municipal corporation ("City"). WHEREAS, County is experiencing explosive residential growth, particularly in the northwestern portion of county, and WHEREAS, it is in the long-term interests of all the citizens of County and City to have a synchronized, progressive, cooperative and comprehensive approach to land use and growth management; NOW THEREFORE, City and County hereby agree as follows: 1) City and County shall endeavor to develop a comprehensive land use/growth management plan, along with the City of Concord, for Northwest Cabarrus County (defined below), using the Highway 73 Corridor Study as a basis. Planning will begin immediately and is to be completed and implemented, including adoption of any desirable ordinances, within six months. Northwest Cabarrus County is the unincorporated portions of Cabarrus County being those portions of Townships 2, 3 and 4 located north of 1-85. 2) County will immediately institute the process required to impose a moratorium on the approval of residential subdivision applications in the unincorporated areas of the county. The moratorium shall have a duration of 6 months. During the moratorium, County shall prepare new development and zoning ordinances substantially similar to those in use in Mt. Pleasant, Harrisburg, Concord and Kannapolis. These new ordinances shall be adopted at or before the end of the moratorium. 3) All residential developments submitting preliminary applications to City or preliminary subdivision plats to County prior to the enactment of the moratorium shall be permitted to proceed to approval through the development review process under the ordinances and regulations in effect at the date of execution of this Memorandum. Nothing in this document shall be construed to relate to or affect commercial or industrial development. 4) City hereby endorses County's effort to ordinances and will support implementation thereof. revise its development 5) County hereby endorses City's efforts to secure legislation by the North Carolina General Assembly that would permit City to voluntarily annex property located within the Kannapolis Annexation Area pursuant to the Annexation Agreement executed between City and the City of Concord. Annexation ordinances, facilitating residential subdivisions, that are adopted during the moratorium shall have an effective date after the moratorium.
