<br />December 20, 2004 (Regular Meeting) <br /> <br />Page <br /> <br />32 <br /> <br />The Board then voted on the motion by Vice Chairman Carruth as set <br />forth below: <br /> <br />UPON MOTION of Vice thairman Carruth, seconded by Commissioner Juba <br />with Chairman Carpenter, vice Chairman Carruth and Commissioner juba voting <br />for and Commissioners Freeman and Privette voting against, the Board adopted <br />the Interim beveloprnent Ordinance that places a six-'-month moratorium on new <br />major subdivisions in the unincorporated areas of Cabarrus County for a <br />period not to exceed six months and added Section 2 (e) "to provide for a <br />public participation process that includes home builders, realtors, citizens <br />and planning board members." The Ordinance as adopted by the Board is as <br />follows: <br /> <br />Ordinance No. 2004-20 <br /> <br />CABARRUS COUNTY, NORTH CAROLINA <br />INTERIM DEVELOPMENT ORDINANCE <br /> <br /> <br />WHEREAS, the Couhty has been experiencing extraordinary <br />growth occasioned by the explosive population and employment <br />expansion of the Charlotte-Mecklenburg region, reflected in ever <br />larger numbers of applications for development approval; and <br /> <br />WHEREAS, planning for and implementing ordinances and <br />regulations for land use and development in the County is <br />urgently needed to meet critical problems of: inadequate and <br />improperly located schools, inadequate transportation facilities; <br />loss of open space and environmental degradation; flooding and <br />inadequate storm water management; and the need for <br />intergovernmental agreements to address urban, suburban, and <br />rural needs and problems; and <br /> <br />WHEREAS, the County is authorized by law to update its <br />adopted Land Use Plans, as necessary, to implement the updated <br />Land Use Plans, and to take action as needed to protect the <br />planning process; and <br /> <br />WHEREAS, the County is authorized by NCGS Chapter 153A to <br />prepare, adopt and amend Land Use Plans, a Zoning Ordinance I <br />Subdivision Regulations and other land use related administrative <br />regulations and ordinances I as necessary, to implement the Land <br />Use Plan and its objectives and to take action to protect the <br />planning process; and <br /> <br />WHEREAS, the cou:nty anticipates commencing and concluding <br />an update of the Land Use Plans and the revisions to the Zoning <br />Ordinance and Subdivision Regulations and other land use related <br />administrative regulations and ordinances within the time frame <br />of this IDO; and <br /> <br />WHEREAS, due to explosive growth pressures and their <br />immediate impact on land use, the environment, and health, safety <br />and general welfare, the County has recognized the need to <br />consider the appropriate location, timing, phasing, level and <br />type of service for all adequate public facilities to be provided <br />by the County, the State of North Carolina, and other adjacent <br />counties I towns and service providers in the County as a whole; <br />and <br /> <br />WHEREAS, the County intends to adopt, upon completion of <br />its review process, updated Land Use Plans and Zoning Ordinance <br />and Subdivision Regulations and other land use related <br />administrative regulations and ordinances, regulating the uses <br />and intensitie~ of development, environmental protection I design, <br />and compatibility; and <br /> <br />WHEREAS I the County recognizes that the planning process <br />for the update I adoption and implementation of the Land Use <br />Plans, Zoning Ordinance, subdivision Regulations and other land <br />use-related administrative regulations and ordinances will <br />require approximately six (6) months, during which time <br />applications for major preliminary residential subdivision plat <br />approval will not be accepted, processed or approved until the <br />termination of this Interim Development Ordinance; and <br /> <br />WHEREAS, <br />County, it is <br /> <br />due to unabated growth pressures throughout the <br />imperative that the County take appropriate action <br />
