Pam Dubois, Deputy County Manager, reported the project could be funded by using existing Capital Reserve funds or by adding this project to possible new debt financing for Cabarrus County Schools. Mike Downs, Deputy County Manager, stated a policy would be developed with the Schools to include this size of gymnasium in the design of future schools. This would eliminate the need to go through a redesign process. UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman and unanimously carried, the Board voted to place the request for building modifications (Enlargement of Gymnasium) for the proposed Carl Furr and Charles E. Boger Elementary Schools on the February 20, 2006 Agenda as a Consent item. Zoning Text Amendment - Change Required Side Yard Setback in Conventional Subdivisions in the Countryside Residential (CR) District Jonathan Marshall, Commerce Director, presented information on a Zoning Text Amendment to change the required side yard setbacks in the Countryside Residential district. The amendment would reduce the side yard setback from 20 to 10 feet single; however, the total setback would remain at 40 feet. He said reducing the setback would allow some flexibility in siting the location of septic tanks in the CR district. A public hearing is required. UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman and unanimously carried, the Board scheduled a public hearing on Zoning Text Amendment C2006-01(ZT) to change the side yard setback in conventional subdivisions in the Countryside Residential (CR) District at 6:30 p.m. on February 20, 2006. Zoning Text Amendment - Addition of Commercial Design Standards Jonathan Marshall, Commerce Director, introduced Susie Zakraisek and reported Ms. Zakraisek was recently promoted from the position of Senior Planner to Planning and Zoning Manager. Susie Zakraisek, Planning and Zoning Manager, presented information on a proposed Zoning Text Amendment [2006-02(ZT)] to add Section 5-9, C. Commercial Design Standards to Chapter 5 of the Cabarrus County zoning Ordinance. She highlighted the following information: (1) The Towns of Mt. Pleasant and Harrisburg adopted the Commercial Design Standards; (2) Appeals will be heard by the Cabarrus County Board of Adjustment; (3) The Cabarrus County Planning and Zoning Commission unanimously endorsed the text amendment at its January 19th meeting; and (4) A public hearing is required. MS. Zakraisek responded to process and which board would make the commercial design standards. several questions concerning the appeal the final decision on appeals related to Board Members expressed a desire to have appeals brought before the Board of Commissioners for final consideration instead of the Board of Adjustment. Mr. Marshall reported staff will prepare options for the appeal process for presentation on February 20. UPON MOTION of Commissioner Freeman, seconded by Commissioner Privette and unanimously carried, the Board scheduled a public hearing on Zoning Text Amendment [C2006-02(ZT)], Commercial Design Standards, at 6:30 p.m., on February 20, 2006. Sewer Line Easement at Concord Middle School and Budget Amendment Jonathan Marshall, Commerce Director, reported a private development company desires to purchase a short easement to construct a sewer line across County property on NC Highway 73 East at Concord Middle School and Irwin Elementary. Representatives from Cabarrus County Schools negotiated a sales price of $5,000.00 and in the past the money from such sales has gone to the schools that are affected by the sale. He said the easement will be dedicated to the City of Concord after construction of the sewer line.
