February 9, 2006 - Recessed Meeting Page 494 Alex Porter, representative of Citizens for a Better Concord and member of the Review Committee, expressed concern that the committee was meeting only once a week. UPON MOTION of Vice Chairman Juba, seconded by Commissioner Carpenter and unanimously carried, the Board approved Amendment No. 7 to the Ware Bonsall Architects Contract for facilitation services and authorized the appropriate budget revision transferring funds from the Capital Reserve Fund to the Law Enforcement Construction Fund. Extension of the Purchase and Sale Agreement with Allen Craven LLC for the former Cabarrus Bank/First Union Building John Day, County Manager, reported that Allen Craven had requested an extension of the Due Diligence and Closing dates as set forth in the Purchase and Sale Agreement (First Amendment) for the former Cabarrus Bank/First Union Building. He stated that Wachovia, which currently leases space in the facility, is working on plans for consolidation of its local offices. Commissioner Carpenter asked to be recused from voting due to her employment with Wachovia Bank. There were no objections, and Chairman Carruth stated that Commissioner Carpenter was recused from voting. UPON MOTION of Commissioner Freeman, seconded by Commissioner Privette with Commissioners Freeman and Privette, Vice Chairman Juba and Chairman Carruth voting for and Commissioner Carpenter abstaining, the Board approved a Second Amendment to the Purchase and Sale Agreement between Cabarrus County and Allen Craven, LLC, for the former Cabarrus Bank/First Union Building. The Amendment amended the original Agreement to define the Final Closing Date as being 300 days after the Effective Date and the Due Diligence Date as being 270 days from the Effective Date. Establishing the Date for a Board Retreat John Day, County Manager, reported the Board was scheduled to conduct County Attorney interviews on March 11 and to hold a Retreat on March 18. He asked that the dates be reversed and the Retreat be held on March 11. The Board agreed by consensus to schedule a Retreat on March 11, 2006, from 9:00 a.m. to 3:00 p.m. in the Multipurpose Room at the Governmental Center. The interviews for the County Attorney position will be scheduled on March 18 to begin at 8:00 a.m. in the Multipurpose Room. NCACC Human Resources Steering Committee Medicaid/Sales Tax Swap John Day, County Manager, reported that he was scheduled to attend a meeting of the N. C. Association of County Commissioners Human Resources Steering Committee during the next week regarding a Medicaid relief proposal. He reported that a proposal by Senator Tony Rand calls for the counties to give up one cent of their sales tax authority to the State in exchange for the State assuming responsibility for the Medicaid costs. In addition, the General Assembly would grant the counties the authority to enact an additional one cent sales tax to replace the lost revenue. Mr. Day asked the Board's guidance in regards to the proposal. There was no support for the proposed Medicaid/sales tax swap. Chairman Carruth recessed the meeting at 6:05 p.m. Joint Meeting with the Midland Town Council to Discuss the Former Bethel Elementary School Chairman Carruth reconvened the meeting in the school cafeteria at 6:10 p.m. for a joint meeting with the Midland Town Council. The following officials from the Town of Midland were present for the meeting: Mayor John Crumpi Mayor Pro-Tem Darrell pagej Council Members Allen Burnette, Kathy Kitts and Chip Furr; Town Attorney Michael Burgner; and Town Clerk Nancy Boyden. Pastor Mark Clontz of the Bethel United Methodist Church gave the invocation.
