This budget amendment is to add the <br />remaining contingencyfunds to the construction line :item for the purpose of <br />purchasing and in$talling internal humidity controls within the heating and <br />ventilation system. <br />Account No. <br />34397509-9660 <br />Contingency - <br />34397509-9820 <br />Construction <br />Present <br />Aooroved Budaet <br />$11,590.00 <br />Ph II Sch Adm <br />$3,062,800.00 <br />(G) NEW BUSINESS <br />Increase Decrease Revised Budget <br />$11,590.00. $0.00 <br />$11,590.00 $3,079,390.00 <br />(G-13) House Hill 1002, Senate Bill 545, Cabarrus Quick Take <br />Chairman Carruth reported the County's legislative delegation <br />introduced companion bills that would give Cabarrus County and municipalities <br />within its boundaries the same "quick take" condemnation authority as the NC <br />Department of Transportation with regard to right-of-ways for utilities and <br />streets. He said concerns about this bill were raised at the last agenda <br />work session and Commissioner Privette was asked to contact the delegation <br />and report back.- He further reported Senator Hartsell and Representative <br />Barnhardt sent responses to Commissioner Privette's inquiry and are included <br />in the agenda. <br />At the request of Vice Chairman Juba, Richard M. Koch, County Attorney, <br />provided a lengthy dissertation on the purpose of House Hill 1002 and Senate <br />Hill 545 and the condemnation process. In summary, he said the essence of <br />the bills requested by the City of Concord is to allow other local <br />governments to use Chapter 136 of the N.C. General Statutes to condemn <br />property for public uses such as utilities (water and sewer) and streets; and <br />that the "quick take" provisions of Chapter 90-A have been in place since <br />1982. After reading an excerpt from Chapter 90-A, a lengthy discussion <br />ensued and Mr. Koch responded to a variety of questions from the Board <br />throughout the discussion, <br />Commissioner Privette made a MOTION to remove Cabarrus County from the <br />Quick Take Bill. <br />
