February 4, 2013 (Work Session) Active Living and Parks Department - FCCA /Park Ordinance Page 1409 Londa Strong, Active Living and Parks Director, advised the F.C. Carolina Alliance (FCCA) Soccer Group (part of the agreement for use of the Frank Liske Park Soccer Complex) held a tournament the weekend of November 9- 11, 2012. She stated the park ranger on duty discovered some opened and unopened alcohol containers. The ranger also reported there was an adult game after the tournament games; however the complex is currently for "youth only" to protect and to aid in the establishment of the turf. Strong advised the Park Ordinance allows for the implementation of up to a 30 day suspension for one violation. The penalty for a second violation is left to the decision of the Board of Commissioners. She stated county management, the county attorney and Active Living and Parks staff met with FCCA to discuss the violations. Richard Koch, County Attorney, worked with the department in crafting a letter to the FCCA President advising of the 30 day suspension and procedures for the second violation. In regards to the first violation, the 30 day suspension was reduced to a two week suspension. The penalty for the second violation is to be determined by the Board of Commissioners. Paul Haddad, FCCA President, stated there had been some changes in their organization since the violation; they have worked to improve communication. He urged the Board to consider a monetary penalty or community service in lieu of a suspension. Haddad advised the FCCA will strive to obey the Park Ordinance and any future infractions will be dealt with appropriately. Shane Carew, FCCA Executive Director; and Michael Applegate, Cabarrus CVB and FCCA Board Member, were also in attendance. Mike Downs, County Manager, clarified the first offense was the on -site alcoholic beverages and has been dealt with by management. He advised the second offense was the adult soccer game played on the "youth only" fields at the complex. He reviewed options for the board. He also stated discussions are ongoing regarding revisions to the agreement between Cabarrus County and FCCA that would enable other organizations use of the complex. He responded to questions from the Board. Commissioner Burrage expressed support for waiving any penalties. Discussion followed. Vice Chairman White questioned what measures the FCCA will implement to ensure the violations do not happen in the future. He also expressed support for waiving a penalty for the second violation but not the first violation concerning alcohol at the Park.
