May 20, 2013 (Regular Meeting) <br />Page 1528 <br />Resolution No. 2013 -07 <br />RESOLUTION OF THE CABARRUS COUNTY <br />BOARD OF COMMISSIONERS RELATING TO THE <br />RIGHTS AND PROTECTIONS OF THE SECOND AMENDMENT <br />TO THE UNITED STATES CONSTITUTION AND <br />ARTICLE I, SECTION 30 OF THE NORTH CAROLINA CONSTITUTION <br />WHEREAS, the Second Amendment to the Constitution of the United States <br />provides as follows: <br />A well regulated militia, being necessary to the security of a <br />free state, the right of the people to keep and bear arms shall <br />not be infringed. <br />WHEREAS, Article I, Section 30 of the North Carolina Constitution <br />provides as follows: <br />A well regulated militia being necessary to the security of a <br />free State, the right of the people to keep and bear arms shall <br />not be infringed; and, as standing armies in time of peace are <br />dangerous to liberty, they shall not be maintained, and the <br />military shall be kept under strict subordination to, and <br />governed by, the civil power. Nothing herein shall justify the <br />practice of carrying concealed weapons, or prevent the General <br />Assembly from enacting penal statutes against that practice. <br />WHEREAS, the President and Vice - President of the United States and /or <br />members of Congress are reportedly considering adopting laws, rules, <br />regulations or executive actions which could have the effect of infringing on <br />the rights of citizens of the State of North Carolina and Cabarrus County to <br />keep and bear arms as provided in the Second Amendment and Article I. Section <br />30. <br />WHEREAS, the Board of Commissioners of Cabarrus County are concerned <br />that such actions could infringe on such rights of the citizens of this <br />County and of North Carolina and the United States generally. <br />THEREFORE, BE IT RESOLVED that the Cabarrus County Board of <br />Commissioners supports in full measure the rights and protections of the <br />Second Amendment to the United States Constitution and Article I, Section 30 <br />of the North Carolina Constitution. <br />BE IT FURTHER RESOLVED that neither the President nor Congress nor the <br />General Assembly of North Carolina pass any law, rule, regulation or other <br />executive or legal action to abridge or modify the Second Amendment or <br />Article I, Section 30, except in such manner as to clarify and fortify the <br />rights and protections of those constitutional provisions. <br />BE IT FURTHER RESOLVED that this resolution be transmitted to the <br />respective clerks of the two chambers of the General Assembly and to each <br />member thereof, as well as to the Governor, the chair of the county <br />commissioners of the other North Carolina counties, the North Carolina <br />Association of County Commissioners and the general public. <br />ADOPTED this 20 day of May, 2013. <br />CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br />/s/ Elizabeth F.
