AN ORDINANCE AMENDING THE CABARRUS COUNTY DEVELOPMENT ORDINANCE <br /> TEXT2017-00003 <br /> BE IT ORDAINED that the Cabarrus Development Ordinance is hereby amended as follows: <br /> AMEND CHAPTER 8, CONDITIONAL USES #21 RECEPTION FACILITIES AS FOLLOWS: <br /> Reception Facilities <br /> Agricultural Open and Countryside Residential districts <br /> a. A complete description of the facility including but not limited to: <br /> 1. Types of events <br /> 2. Days and hours of operation <br /> 3. Projected number of users per weekday and weekend days, with the maximum number <br /> expected at any one event <br /> 4. Total nHn9b„r of seats rapacity for the venue <br /> 5. Types of accessory uses, if any, envisioned on the site (includes any accessory <br /> structures) <br /> 6. Total number of employees, both full-time and part-time. <br /> 7. Any and all other relevant information that will help describe the facility <br /> 8. Building elevations for all permanent structures to be used to accommodate receptions <br /> and/or events on the site <br /> b. The minimum size of the proposed site shall be based on the following eent in at leas` five <br /> s. <br /> Capacity Minimum Acreage Required <br /> Up to 100 guests 5 <br /> 101-200 guests 7.5 <br /> 201-300 or more guests 10 <br /> c. A residential structure that is used for a reception facility shall not be altered in any way that <br /> changes its general residential appearance. Building height and other dimensional <br /> requirements for new construction shall be governed by the zoning district in which the <br /> property is located. New construction must meet commercial design standards. <br /> d. All structures, viewing areas, seating and parking areas shall be set back at least one two <br /> hundred (4-99 200) feet from any street or property line. <br /> a. When a site contains existing vegetation that will remain undisturbed and creates <br /> complete visual separation and serves to abate noise levels, the Board of Adjustment, <br /> as part of the Conditional Use Permit consideration process, may reduce the required <br /> setbacks of 200 feet to no less than 100 feet. <br /> i. If the applicant proposes to use this provision, following shall be provided as <br /> part of the conditional use permit application: <br /> 1. Tree survey showing existing vegetation <br /> 2. Landscape plan that provides supplemental plantings as needed to fill <br /> gaps that may exist <br /> b. When the applicant demonstrates to the Board of Adjustment that the existing <br /> vegetation meets the intent of the buffer requirement this area may be used to satisfy <br /> the buffer requirement of standard °h" of this section. <br /> G-1 Page 129 <br />
