If there is a difference in the zoning <br /> ordinance setback and the no build buffer, the greater of the two shall apply. No buildings or <br /> structures shall be permitted in the no build buffer area. Minimal land disturbance, including the <br /> clearing of underbrush, is allowed in the no build buffer. <br /> 15. Where the Waterbody Buffer Zone or no build buffer impacts or is part of a lot, a note shall be <br /> placed on the plat or site plan and a restriction shall become part of the deed for the property <br /> stating that said property is subject to the Waterbody Buffer Zone. <br /> a. Land within a stream buffer shall not be used to meet the minimum area <br /> requirements for lots that are one acre or less. <br /> b. If a lot is greater than one acre in area, except where lots are greater than one <br /> acre in area, the buffer area may be used to meet the minimum lot size <br /> requirements, however, at least 50 percent of the lot shall remain outside the <br /> stream buffer area. <br /> 16.
