ORDINANCE OF THE CABARRUS <br /> 1792 COUNTY BOARD OF COMMISSIONERS <br /> AMENDING THE CABARRUS COUNTY CODE OF <br /> ORDINANCES <br /> WHEREAS, Cabarrus County regulated Cable Television including the granting of franchises through <br /> Chapter 20 of the Code of Ordinances; and <br /> WHEREAS, the State of North Carolina adopted legislative changes codified in General Statute Chapter <br /> 66 Article 42 entitled "State Franchise for Cable Television Service"; and <br /> WHEREAS, that statute designates the Secretary of State as the exclusive franchising authority for cable <br /> service provided over a cable system; and <br /> WHEREAS, the statutory designation replaces the authorization to counties to award a franchise and <br /> makes Chapter 20 of the Code of Ordinances unnecessary; <br /> NOW THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT: Chapter 20 <br /> "Cable Television" of the Cabarrus County Code of Ordinances shall be repealed and the Chapter marked <br /> as "Reserved". <br /> Stephen M.
