CABARRUS COUNTY <br />w r; <br />BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />MARCH 21, 2016 <br />i �'y�J,rJJl� ll <br />1 <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />Cooperative Extension - Proposed Amendment to the Code of Ordinances <br />Regarding the Voluntary Agricultural District Ordinance - Public Hearing <br />6:30 P.M. <br />BRIEF SUMMARY: <br />The Cabarrus County Agricultural Advisory Board recommends two <br />revisions to the Voluntary Agricultural District Ordinance to better align <br />with Chapter 106, Article 61 of the North Carolina General Statutes <br />(Agricultural Development and Preservation of Farmland). <br />Specifically, it is recommended to revise the required definition of <br />"Qualifying Farmland" to remove the farm present- use -value taxation <br />program and replace it with the terminology now used in the state statute <br />(G.S. 106 - 581 -1) <br />Also to clarify the renewal of the Voluntary Agricultural District is automatic <br />every 10 years unless the landowner provides written notice no later than <br />30 days prior to the termination date. <br />The exact changes in Article VII are: <br />In order for farmland to qualify for inclusion into the voluntary agricultural <br />district or the enhanced voluntary agricultural district, it must be real <br />property that: <br />1. Is engaged in agriculture as that word is defined in G.S. 106 - 581.1.1 <br />2. Be the subject of a conservation agreement as defined in N.C.G.S. <br />121 -35, between the county and the owner of such land that prohibits <br />non -farm use or development of such land for at least ten years, except <br />G -2 Page 111 <br />
