STATE OF NORTH CAROLINA <br />MEMORANDUM OF UNDERSTANDING <br />COUNTY OF CABARRUS <br />This MEMORANDUM OF UNDERSTANDING ( "MOU ") is made and entered into by and among <br />CABARRUS COUNTY ( "County'), CABARRUS COUNTY SCHOOL SYSTEM ( "County Schools ") and ROWAN <br />CABARRUS COMMUNITY COLLEGE ( "Community College ") <br />RECITALS <br />1. The County is the owner of a parcel of land located off U.S. Highway 29 /Concord Parkway North <br />at Parkway Avenue NW. That parcel is identified by County Parcel Identification Number 5611- <br />91 -6521. <br />2. The Community College operates the Rowan Cabarrus Business & Technology Center at that <br />site. <br />3. The County Schools wish to operate a campus of their Early College on the same site. <br />4. The County Schools plan to locate two modular buildings on the parcel for the purpose of <br />operating the Early College campus. <br />5. The parties understand and acknowledge that separate legal documents are in place for the <br />purpose of providing the specific terms and agreements related to the operation of the early <br />College between the County Schools and Community College. <br />6. The purpose of this MOU is to memorialize the discussions and agreements of these parties <br />relative to the location and operation of the new Early College campus at this site. <br />Based on the foregoing Recitals and the Provisions contained below, the parties agree as follows: <br />PREMISES <br />1. By separate approval and agreements the County has provided funding for the modular <br />buildings and site construction to locate the Early College on this campus. <br />2. The County Schools have employed an architect and engineer for the purpose of planning the <br />location and construction of the Early College campus including compliance with all zoning and <br />building requirements. <br />3. The architect and engineer have prepared a site plan, a copy of which is attached for reference, <br />that has been reviewed by representatives of the County, County Schools and Community <br />College. <br />4. The County Schools will be responsible for all direct oversight of site preparation, building <br />placement, related utility infrastructure and all other improvements that are part of the Early <br />College campus. County Schools shall coordinate all of this activity with the Community College. <br />5. Utilities for the Early College such as water, sewer, storm water and electricity shall be the <br />responsibility of the County Schools. <br />6.
