Resolution Authorizing Transfer of Property <br />' 192 411 RCCC Business & Technology Center Buildings and Land <br />WHEREAS, Cabarrus County is the owner of a parcel of land located on <br />U.S. 29 and Parkway Avenue identified by Parcel Identification Number 5611-91 - <br />8053 (the "Property "); and <br />WHEREAS, N.C. General Statute 160A -279 permits the sale of properties to entities carrying out <br />a public purpose; and <br />WHEREAS, the County acquired the buildings and land from Cabarrus County Schools in 2003, and <br />remodeled it for use by Rowan Cabarrus Community College in 2004 -2005 including a lease agreement <br />for that purpose ; and <br />WHEREAS, the Cabarrus County, Rowan Cabarrus Community College and Cabarrus County <br />Schools have approved a Memorandum of Understanding for a campus of the Early College to be located <br />on this site; and <br />WHEREAS, the Board of Commissioners previously agreed by consensus that documents should <br />be prepared to transfer ownership of the building and land to Rowan Cabarrus Community College; <br />THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT; <br />1. The County Commissioners authorize the sale of the property described above through the <br />procedures outlined in North Carolina General Statute 160A -279. <br />2. The County Clerk shall cause a notice of the proposed exchange to be published. The notice <br />shall describe the property, the proposed exchange and purchase. <br />3. The terms of exchange are that: <br />a. The County Manager and County Attorney must complete the final terms and conditions <br />for the property exchange. <br />b. The sale shall include covenants that restrict the use of the property for a public purpose <br />as outlined in G.S. 160A -279 and that all existing agreements, except as noted in 3c below, <br />between Cabarrus County, Rowan Cabarrus Community College and Cabarrus County <br />Schools shall remain in effect. <br />c. The lease agreement effective July 1, 2004 between Cabarrus County and Rowan <br />Cabarrus Community College shall be terminated. <br />Adopted this the 15t day of August, 2016. <br />Stephen M.
