Cabarrus County Zoning Ordinance <br />Chapter 13 Amendments and Changes <br />Section 1349. 13 Violation of the terms and conditions of an "SU" er "C--B" District <br />rezoning <br />A violation of a condition of rezoning to an "SU " er" District as set forth in the final <br />site specific development plan and other related official paperwork associated with <br />such rezoning shall be treated the same as a violation of this Ordinance, subject to the <br />same remedies and penalties. <br />Upon determining that such a violation has occurred, the Zoning Adminis ator shall <br />notify the property owner of 4i-, ., 'iµ% findings either by certified mail or i erson, and <br />set a reasonable time for the violation to be corrected or abated. W la i, n is <br />not corrected or abated within the time period set by the Zoningdminis tor, the <br />Zoning Administrator or any aggrieved person may institute <br />mandamus (eeuF+ eFdeF', or other appropriate action-imn-90 <br />abate the violation. <br />Section 1349. 14 Effect of denial on subsequen s for <br />n inju tion, <br />correct or <br />ing amendment <br />An application for a zoning amendment that has4fen doied, in whole or in part, e <br />H-,- b een a e d f„r a m .e. r e i rest i re i r e t i ve relass,fi.reati„r than r este 4 shall not again <br />be processed for consideration by the County for a one (1) year period from the date of <br />t h e application, The Zoni inistrator may waive the one (1) year waiting period if <br />it is determined th ere substantial changes to a previously proposed rezoning <br />petition that was co i he Planning and Zoning Commission and denied. <br />This restr' on s II n apply to any amendment or petition submitted by the Planning <br />and Zonin i , Planning Staff or the Board of County Commissioners. <br />PA VI VE ING OF DEVELOPMENT RIGHTS <br />Section . 15 Vesting of development rights under County Ordinance <br />A developer /owner may petition to establish a vested right under the Ordinance to <br />complete a project by making a formal request to the Planning and Zoning Commission. <br />Vested rights may only be requested for a previously approved site specific <br />development plan. <br />Chapter 13 Page 15 of 18 <br />Amended <br />Attachment number 1 \n <br />G -4 Page 396 <br />
